Heard learned counsel for the revisionists.
Order dated 07.1.2010 passed by Addl. Sessions Judge Court
No.3, Mau on an application under section 319 Cr.P.C. is
impugned in the instant revision.
The revisionist were named accused in the First Information
Report. After recording statement of PW1 first informant, the
order was passed summoning the revisionist to face trial along
with other accused.
I have perused the First Information Report and impugned orders
as well as statement of the witness Ram Chandra Yadav s/o Murli
Yadav. I do not find any illegality in the impugned order. Revision
lacks merit and is accordingly dismissed.
It is brought to my notice that all the other accused who are facing
trial have been allowed bail. In the event revisionists appear within
a period of ten days from today before court below and move bail
application, the same shall be considered expeditiously ,
preferably, if possible on the same day.
