J U D G M E N T
The petitioner is working as Re-touching Artist Grade-I
in the Government Press, Mannanthala. According to the
petitioner, he is entitled to be promoted as Supervisor
(Plate Making/Reproduction), as per the Draft Special Rules
framed, which is pending finalisation. The petitioner
therefore submits that, in view of Exts.P6 & P7 judgments,
the respondents are bound to make promotions in
accordance with the Draft Special Rules, which is not being
done. The petitioner submits that, the petitioner is now put
in charge of the post of Supervisor (Plate
Making/Reproduction) and he is to retire from service on
31.03.2011. The petitioner therefore seeks the following
reliefs:
i) Declare that the petitioner is entitled to get promotion to
the post of Supervisor (Plate Making) in the Government
Press, Mannanthala which arose on 29.06.2010 in
accordance with Ext.P5 Draft Special Rules;
ii) Issue a writ of mandamus or any other appropriate writ,
direction or order directing the respondents to forthwith

promote the petitioner to the post of Supervisor (Plate
Making) in the Government Press, Mannanthala;
iii) Issue a writ of mandamus or any other appropriate writ,
direction or order directing the Respondents to fill up the
vacancy of Supervisor (Plate Making) which arose on
29.06.2010 in accordance with Ext.P5 Draft Special
Rules as directed by this Hon’ble Court in Exhibits P-6
and P-7 judgments.
iv) Issue a writ of mandamus or any other appropriate writ,
direction directing the respondents to consider Exhibit
P-8 representation in the light of Exhibit P-6 judgment
and promote him to the post of Supervisor (Plate
Making) in the Government Press, Mannanthala, which
arose on 29.06.2010;
I have heard the learned Government Pleader also. In
the facts and circumstances of the case, I am of opinion
that, it is only appropriate that the 2nd respondent considers
the claim of the petitioner for promotion in the light of
Exts.P6 & P7 judgments. This shall be done as
expeditiously as possible, at any rate within two months
from the date of receipt of a copy of this judgment, after
affording an opportunity of being heard to the petitioner.
