Heard learned counsel for the applicant and learned A.G.A.
appearing for the State.

It is contended by the learned counsel for the applicant that
co-accused Srinath and Madhav have been granted bail by
Sessions Judge and bail application of the applicant was
rejected merely on the ground that applicant was having
country made pistol at the time of running away from the
spot. it is further contended that deceased executed Will in
favour of the informant and murder was committed inside the
house of the informant and thereafter applicant has been
falsely implicated in this case.

Learned A.G.A. contended that applicant was also involved
in committing the murder of the deceased and was seen
running away from the spot.

Co-accused Srinath and Madhav have been granted bail by
the Sessions Judge. There is no eyewitness account.
Applicant has no criminal history and he is in jail since
16.4.2010.

Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant
and without expressing any opinion on the merits of the
case, the applicant is entitled to be released on bail.

Let the applicant Udhao involved in Case Crime No. 267 of
2010 , under Section 302 IPC Police Station Mau District
Chitrakoot be released on bail on his furnishing a personal
bond with two sureties each in the like amount to the
satisfaction of the court concerned.
