Justice C.T.RAVIKUMAR\n\n Dated :05\/05\/2009\n\n O R D E R\n                        C.T.RAVIKUMAR, J.\n                  -------------------------------------------\n                      B.A.No.2229 of 2009\n                  ------------------------------------------\n               Dated, this the 5th   day of May, 2009\n\n                             ORDER\n<\/pre>\n<p>              This is an application for anticipatory bail filed<\/p>\n<p>under Section 438 of the Code of Criminal Procedure.          The<\/p>\n<p>petitioner is the first accused    in Crime No.192 of 2009 of<\/p>\n<p>Medical College Police Station, Kozhikode alleging commission<\/p>\n<p>of offences punishable under Sections 323, 498-A, 427 read<\/p>\n<p>with Section 34 of the Indian Penal Code.\n<\/p>\n<p>             2. The marriage between the petitioner and the de<\/p>\n<p>facto complainant was solemnized on 19.8.2007 and according<\/p>\n<p>to the petitioner, from 10.2.2008 onwards they have been<\/p>\n<p>living separately. Along with the petitioner herein, his parents<\/p>\n<p>and brothers were also implicated as accused in the aforesaid<\/p>\n<p>crime.    They approached the Sessions Court, Kozhikode by<\/p>\n<p>filing Crl.M.C.No.462 of 2009 for anticipatory bail. After having<\/p>\n<p>elaborate consideration, the Sessions Court granted anticipatory<\/p>\n<p>bail in respect of the parents and brothers of the petitioner<\/p>\n<p>herein, considering the fact that the de facto complainant had<\/p>\n<p>not attributed any overtact to prove their involvement in the<\/p>\n<p>B.A.No.2229 of 2009<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>case.     In respect of the petitioner, his application for<\/p>\n<p>anticipatory bail was rejected.\n<\/p>\n<p>            3.    As stated earlier, the marriage between the<\/p>\n<p>petitioner and the de facto complainant was solemnized on<\/p>\n<p>19.8.2007 and their marital relationship was short-lived.     The<\/p>\n<p>strained relationship compelled them to live separately and now<\/p>\n<p>they have been living separately. Considering the nature of the<\/p>\n<p>allegations levelled against the petitioner as also the progress of<\/p>\n<p>the investigation in this case, I think the petitioner can be<\/p>\n<p>granted anticipatory bail.\n<\/p>\n<p>            4. Accordingly this application is allowed subject to<\/p>\n<p>the following conditions:\n<\/p>\n<p>            i) In the event of his arrest, the petitioner shall be<\/p>\n<p>released on bail on executing a bond for Rs.50000\/- with two<\/p>\n<p>solvent sureties for the like sum each to the satisfaction of the<\/p>\n<p>officer conducting the arrest.\n<\/p>\n<p>            ii)   The    petitioner  shall   report   before   the<\/p>\n<p>investigation officer once in a week, viz. on all Saturdays<\/p>\n<p>between 10 a.m. and 11 a.m. till the final report is laid.<\/p>\n<p>            iii) Petitioner shall not tamper with or attempt to<\/p>\n<p>tamper with evidence or intimidate or influence or attempt to<\/p>\n<p>B.A.No.2229 of 2009<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>intimidate or influence the witnesses.\n<\/p>\n<p>            iv) This order will be in force for a period of two<\/p>\n<p>months and thereafter the petitioner may move appropriate<\/p>\n<p>Court having jurisdiction for regular bail.<\/p>\n<p>                                    C.T.RAVIKUMAR, JUDGE<br \/>\nvns<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rishanth.M. vs C.I.
