The<br \/>\nrespondent has committed defaults in repayment of the loan and the<br \/>\ndues have reached to the tune of about Rs.11 Lakhs which are not<br \/>\nbeing paid by the respondent despite repeated request. It is further<br \/>\nclaimed that the statutory notice was issued and the same has been<br \/>\nduly served on the respondent. Learned advocate for the petitioner<br \/>\nhas relied on the acknowledgment establishing the service of notice.<br \/>\nIt is further claimed that despite of statutory notice, the<br \/>\nrespondent has not given any response and has not raised  any dispute<br \/>\nwith regard to its obligation.  He has further submitted that the<br \/>\nrespondent &#8211; company has not only failed to respond to the<br \/>\nstatutory notice but has also not responded to the notice issued in<br \/>\nthe present petition and despite the service, it has not cared to<br \/>\neven enter appearance. Learned advocate for the petitioner has<br \/>\nsubmitted that the petitioner was permitted Direct Service of<br \/>\nprocess, which has been served  and affidavit of service has been<br \/>\nfiled. Nonetheless, the respondent has not responded, it has not<br \/>\nentered appearance and until now the claim of the petitioner &#8211;<br \/>\nBank has remained undisputed and uncontested and at the same time, it<br \/>\nhas not been paid also.\n<\/p>\n<p>[3]\tHaving<br \/>\nregard to the aforesaid aspects, it has become necessary to admit the<br \/>\npetition. Hence, the following order is passed:-\n<\/p>\n<p>\tADMIT.\n<\/p>\n<p>However,<br \/>\nthe affidavit of admission of petition is differed with a view to<br \/>\ngiving last opportunity to the respondent. For the aforesaid purpose,<br \/>\nthe petitioner is permitted to effect the service of process of<br \/>\nadmission of petition to the respondent. The Registry shall issue<br \/>\nprocess of intimating the admission of the petition to the respondent<br \/>\nwhich shall be served through the office as well as directly by the<br \/>\npetitioner. The petitioner shall effect the service directly as well<br \/>\nas by registered post A.D and file affidavit of service along with<br \/>\nsupporting documents. On the next day, the issue about issuance of<br \/>\nadvertisement as well as appointment of Provisional \/ Official<br \/>\nLiquidator shall be considered. In the meanwhile, the respondent &#8211;<br \/>\ncompany and its agents are restrained from alienating and \/ or<br \/>\ncreating any charge over its assets.\n<\/p>\n<p>[<br \/>\nK. M.
