Thereafter he was<br \/>\npromoted to the post of Art-A Fitter category w.e.f. 04.05.1980.  The<br \/>\npetitioner raised a grievance that the junior working on the said<br \/>\npost is getting higher pay than him and, therefore, the respondent<br \/>\nshould also fix pay scale, given to the junior working on the said<br \/>\npost. As no action was taken by the respondent for fixation of his<br \/>\npay, the petitioner raised a dispute which was ultimately referred to<br \/>\nthe Industrial Tribunal for adjudication being Reference [IT] No.<br \/>\n236\/1992. Before the Industrial Tribunal both the parties adduced<br \/>\nevidence and on the basis of the material produced before it, the<br \/>\nIndustrial Tribunal rejected the said reference. Hence, this<br \/>\npetition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It appears that petitioner and one Mr. Sharma, both are<br \/>\nworking in different cadres inasmuch as the petitioner is<br \/>\nworking on the post of Art-A Tyre Fitter, whereas Mr. Sharma is<br \/>\nworking on the post of Art-A Mechanic Driver and therefore, their pay<br \/>\nscales are different.  The said fact is established from the<br \/>\nseniority list produced at Exhibit-31\/1.  The Industrial Tribunal has<br \/>\nrecorded the finding that for both the cadres different pay scales<br \/>\nare fixed.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the facts of the case and in view of the fact that as per GSO<br \/>\ndifferent pay scales are fixed for different cadre, the view taken by<br \/>\nthe Industrial Tribunal is just and proper.<br \/>\n I am in complete agreement with<br \/>\nthe reasonings given and findings<br \/>\narrived at by the Industrial Tribunal  and hence, do not find any<br \/>\nreason to interfere with  the same.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result,  the petitioner is dismissed. Rule is discharged.
