DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Learned APP Ms.Manisha L Shah waives service of notice notice of Rule<br \/>\nfor respondent-State.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered at<br \/>\nC.R.No.I-48 of 2011 with Veraval Police Station, District Junagadh<br \/>\nfor the offences punishable under Sections 408, 409, 418, 465, 467,<br \/>\n468 and 471 of the Indian Penal Code.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel for the applicant submits that the applicant is accused of<br \/>\noffences punishable and triable by learned Magistrate and at the<br \/>\noutset, prima facie it appears to be a case of temporary<br \/>\nmisappropriation and the total amount of Rs.55,622.48 ps. alleged to<br \/>\nhave been misappropriated is already deposited. The applicant is<br \/>\nhaving above twenty years of service and by and large, the service<br \/>\nrecord of the applicant is good and is not likely to abscond and<br \/>\nhaving permanent residence etc. It is further submitted that in view<br \/>\nof the above, the applicant may be granted anticipatory bail.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned APP for the respondent-State.\n<\/p>\n<p>5.\t\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicant. This Court has<br \/>\nalso taken into consideration the law laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre V. State of Maharashtra &amp;<br \/>\nOrs. Reported<\/a> in (2011)1 SCC 694, wherein the Apex Court reiterated<br \/>\nthe law laid down by the Constitutional Bench in the case of Shri<br \/>\nGurubaksh Singh Sibbia &amp; Ors. Reported in (1980)2 SCC 565.\n<\/p>\n<p>6.\t\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being<br \/>\nC.R.No.I-48 of 2011 registered with Veraval Police Station, Junagadh,<br \/>\nthe applicant shall be released on bail on furnishing a bond of<br \/>\nRs.10,000\/- (Rupees ten thousand only) with one surety of like amount<br \/>\non following conditions:\n<\/p>\n<p>a)\tshall<br \/>\ncooperate with the investigation and make himself available for<br \/>\ninterrogation.\n<\/p>\n<p>b)\tshall<br \/>\nremain present at the concerned Police Station on 28.7.2011 between<br \/>\n11.00 am to 2.00 pm.<\/p>\n<p>c)\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer.\n<\/p>\n<p>d)\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders.\n<\/p>\n<p>e)\twill<br \/>\nnot leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately.\n<\/p>\n<p>f)\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide on merits.\n<\/p>\n<p>g)\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>8.\t\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\t\tRule<br \/>\nmade absolute. Application is disposed of accordingly.
