SIRI JAGAN, J\n                  ...............................................\n                    W.P.(C) No. 35564 of 2008\n                 .................................................\n              Dated this the 1st day of July, 2009\n\n                            J U D G M E N T\n<\/pre>\n<p>      The petitioner filed this writ petition seeking the following<\/p>\n<p>reliefs:\n<\/p>\n<blockquote><p>             &#8220;i)    Issue a writ of mandamus or any other<br \/>\n      appropriate writs, orders or directions commanding the 3rd<br \/>\n      respondent      to   issue    transfer    certificate    and other<br \/>\n      documents of the petitioner forthwith, without any further<br \/>\n      delay;\n<\/p><\/blockquote>\n<blockquote><p>             ii)    Issue a writ of mandamus or any other<br \/>\n      appropriate writs, orders or directions commanding the 4th<br \/>\n      respondent to keep one seat in the course &#8211; Information<br \/>\n      Technology &#8211; vacant, till the petitioner gets transfer<br \/>\n      certificate and other documents from the 3rd respondent<br \/>\n      college;\n<\/p><\/blockquote>\n<blockquote><p>             iii)   Issue a writ of mandamus or any other<br \/>\n      appropriate writs, orders or directions commanding the<br \/>\n      respondents 1 and 2 to take action against the 3rd<br \/>\n      respondent for the non-issuance of transfer certificate to<br \/>\n      the petitioner;&#8221;<\/p><\/blockquote>\n<p>      On 11.12.2008 this court passed the following interim<\/p>\n<p>order in this writ petition.\n<\/p>\n<blockquote><p>            &#8220;Heard learned counsel for the petitioner Sri. Babu<br \/>\n      S. Nair and Sri. R.Ramadas, learned counsel appearing for<br \/>\n      the third respondent. Counter affidavit has been filed by<br \/>\n      the third respondent.          The stand taken by the third<br \/>\n      respondent is that the Commissioner is not entitled to<br \/>\n      accept higher option of a student after the second<br \/>\n      allotment. He refers to clause 3 in Ext.R3(a) agreement<br \/>\n      executed in this behalf between the Kerala Self Financing<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 35564 of 2008           -2-<\/span><\/p>\n<p>      Engineering College Managements&#8217;         Association and the<br \/>\n      State. The third respondent submits that Ext.P5, the<br \/>\n      allotment made by the Commissioner on 22.10.2008 is<br \/>\n      illegal.\n<\/p><\/blockquote>\n<blockquote><p>            2. I am of the view that it is not open to the third<br \/>\n      respondent to collaterally challenge Ext.P5.    There are no<br \/>\n      other circumstances pointed out to refuse to issue the<br \/>\n      transfer certificate of the student concerned.\n<\/p><\/blockquote>\n<blockquote><p>            3. Sri. Ramdas submits that the student is bound to<br \/>\n      pay liquidated damages to the institution for an amount<br \/>\n      equivalent to the entire fees which he otherwise would<br \/>\n      have paid, had he completed four years of study. But it is<br \/>\n      admitted that a bond or any other form of security has not<br \/>\n      been furnished by the student. If the college is entitled to<br \/>\n      recover any damages from the student, then it is open to<br \/>\n      the college to pursue such a course of action. Accordingly,<br \/>\n      there will be a direction to the third respondent to issue to<br \/>\n      the petitioner the transfer certificate and other documents,<br \/>\n      as directed in Ext.P5 on or before 16.12.2008. It is made<br \/>\n      clear that immediately thereupon the petitioner shall<br \/>\n      present himself before the 4th respondent college and the<br \/>\n      4th respondent shall be bound to admit the petitioner if the<br \/>\n      petitioner presents himself on or before 19.12.2008.&#8221;<\/p><\/blockquote>\n<p>      Now it is submitted by both sides that pursuant to the<\/p>\n<p>interim order, Transfer Certificate has been issued and therefore<\/p>\n<p>the writ petition may be disposed of in terms of the interim<\/p>\n<p>order. Ordered accordingly. However, I make it clear that the<\/p>\n<p>claim of the 3rd respondent for liquidated damages is left open to<\/p>\n<p>be agitated in appropriate proceedings.<\/p>\n<p>                                            S.
