Tholasanajka, who died in\n\n   accident that occurred on 7.12.2000 at about 3.00\n\n  due to the rash and negligent driving by the\n\nWM.\u00bb\n\n -\u00abvtdriver of the Temp\ufb01aring Reg.No.KA.07.1302 near\n\ng_\u00ab-----=*\"\"\"\"\"v'\u00a2'\nf\nL\n\n \n\n\n\nKarachikkanahalli, when he has applied the brakeVs_,i\"l_t\n\nis the further case of the claimants that, dec_e\u00a7ased_' _\n\naged about 45 years, working as Eolice  \u00a3'l'I_1Cl\\:* .,..\n\ndrawing the salary of $6,500\/- per \n\nafter the welfare of the famiiyhand   tttiatimelyh\n\ndeath, they have ,'.%Uff\u20ac1'(3_d:u:\"xbGt1'l  and\neconomically. On accountgof the deceased,\n\nClaimants have filed a ci'airn:Tpetiti'on that the Tribunal\n\nunder secticln   claiming compensation\nagainst   andlnsurer of the offending\nVehicle. The-  had come up for\n\nconsideration.'  tlhellifribunal. The Tribunal after\n\n 'hearing loothl~tA_sidesv\"'and after assessing the oral and\n\ndocurnen-ta-ry eyi.dence has accepted the contentions of\n\nl  the l'nsu..i'e1'~,l'\u00abthat the deceased was travelling in the\n\n Vehicle and thereby there cannot be any liability\n\n part of the Insurer. However, the Tribunal\n\nT -jwplacing reliance on the judgment reported in ILR 2004\n\nt \" :Karnataka 4622 s.c.,\u00a7 held that though the vehicle in\n\nI --\u00bb--'\"\"\"'\"\"'\"\"\"\"\"\ni\n\n \n\n\n\nquestion is a goods vehicle, it was covered witli.\n\nInsurance as on the date of the accident  V'\n\nthe Insurer is liable to pay the I-claimants  \n\ninstance and it is at liberty to reco:Verl--t_he same from  ''\n\nowner of the vehicle and  \nclaim petition in part -\nas compensation under interest at\n6% p.a., from; date 2 I the payment.\nBeing aggrieyed'   and award, the\nlnsurerighas    seeking appropriate\nreliefs as stated   ..  \" ' it \n\nKl-. . Welluhayaeeheard the learned counsel appearing\n\n for V\"insu'r*er'l'e.lg_and learned counsel appearing for\n\n Fourth respondentowner of the Vehicle<\/pre>\n

vehicle are not covered the risk -of 1-nsurancell <\/p>\n
therefore, the liability cannot be  <\/p>\n
to pay the claimants at the “instance  torecover
\nthe same from the owner of  \u00abThe Tribunal,
\nafter assessing the oral evidence
\navailable on iahaiswll just and
\nreasonable 20\/- towards loss of
\ndependencv    conventional heads
\nand therefore,’  this Court is not called<\/p>\n
for. However’, Vtheifritrunal has committed an error of<\/p>\n
 law’ and Eilliegality, resulting in miscarriage of justice in<\/p>\n
iAs–sui.ng’addirecltivon to the Insurer to pay the claimants<\/p>\n

it  ovvner of the vehicle, contrary to the well settled law<\/p>\n
 by the Apex Court in the case of National<\/p>\n
