NO.4066     OF 2008\n            ===========================\n\n     Dated this the 18th day of December,2008\n\n                       ORDER\n<\/pre>\n<p>    Revision petitioner is challenging the order<\/p>\n<p>passed by Judicial First Class Magistrate Court,<\/p>\n<p>Pattambi in CMP 3559\/2008 a petition filed by him<\/p>\n<p>under section 457 of the Code of Criminal Procedure<\/p>\n<p>for  interim   custody   of  mini   lorry   bearing<\/p>\n<p>registration No.KL-9B\/7380 which was seized by the<\/p>\n<p>Sub Inspector of Police, Pattambi on 23.11.2008 for<\/p>\n<p>illegal transportation of river sand.       Learned<\/p>\n<p>Magistrate dismissed the petition holding that if<\/p>\n<p>interim custody is granted, the vehicle will be<\/p>\n<p>used for the offence.\n<\/p>\n<p>    2.  Learned counsel appearing for the revision<\/p>\n<p>petitioner and the learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    3.  There is no case for public prosecutor that<\/p>\n<p>any confiscation order was passed by the District<\/p>\n<p>Collector.   In such circumstance, the Magistrate<\/p>\n<p><span class=\"hidden_text\">CRRP 4066\/2008             2<\/span><\/p>\n<p>can   grant    interim custody of  the  vehicle as<\/p>\n<p>provided under section 457 of the Code of Criminal<\/p>\n<p>Procedure with sufficient conditions.<\/p>\n<p>     Revision is allowed.     Judicial First Class<\/p>\n<p>Magistrate, Pattambi is directed to grant interim<\/p>\n<p>custody of the vehicle to the revision petitioner<\/p>\n<p>on the following conditions.
