BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                  Crl.M.C.No. 2971 of 2008\n                  - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 6th day of August, 2008\n\n                               O R D E R\n<\/pre>\n<p>       The petitioners face indictment as accused 1 and 2 in a<\/p>\n<p>prosecution under Section 392 r\/w. 34 I.P.C. They were arrested<\/p>\n<p>and were enlarged on bail at the crime stage. Later final report<\/p>\n<p>has been filed. Cognizance has been taken. Though the calender<\/p>\n<p>case was registered in 2001 the petitioners have not so far entered<\/p>\n<p>appearance.    The learned Magistrate had initially issued a<\/p>\n<p>bailable warrant and subsequently non-bailable warrant has been<\/p>\n<p>issued against the petitioners. The petitioners find such processes<\/p>\n<p>issued by the learned Magistrate chasing them.<\/p>\n<p>        2. The learned counsel for the petitioners submits that<\/p>\n<p>issue of such coercive processes against the petitioners is totally<\/p>\n<p>unjustified. They were on bail. Thereafter they were not served.<\/p>\n<p>Without and before service is effected on them, bailable warrant<\/p>\n<p>initially and non-bailable warrant subsequently issued against<\/p>\n<p>the petitioners is not justified.        They are willing to surrender<\/p>\n<p>Crl.M.C.No. 2971 of 2008<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>before the learned Magistrate, but he apprehend that their applications<\/p>\n<p>for bail may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously. It is in these circumstances<\/p>\n<p>prayed that appropriate directions may be issued to release the<\/p>\n<p>petitioners on bail on the date of surrender itself.<\/p>\n<p>      3. It is certainly for the petitioners to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>under which they could not earlier appear before the learned<\/p>\n<p>Magistrate. I have no reason to assume that the learned Magistrate<\/p>\n<p>would not consider the applications for bail to be filed by the<\/p>\n<p>petitioners when they surrender before the learned Magistrate on<\/p>\n<p>merits, in accordance with law and expeditiously. Every court must<\/p>\n<p>do the same. No special or specific direction appears to be necessary.<\/p>\n<p>Sufficient general directions have already been issued by this Court in<\/p>\n<p>the decision in <a href=\"\/doc\/1516775\/\">Alice George v. Dy.S.P. of Police<\/a> (2003 (1) KLT<\/p>\n<p>339).\n<\/p>\n<p>      4. This application is accordingly dismissed.      I may however<\/p>\n<p>hasten to observe that if the petitioners appear before the learned<\/p>\n<p>Magistrate and apply for bail after giving sufficient prior notice to<\/p>\n<p>Crl.M.C.No. 2971 of 2008<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate must<\/p>\n<p>proceed to pass orders on merits, in accordance with law and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>      5. The order sheet has been produced. In the peculiar facts and<\/p>\n<p>circumstances, there shall be a direction that the warrant of arrest<\/p>\n<p>issued against the petitioners shall not be executed till 20.8.2008. On<\/p>\n<p>or before that date the petitioners shall appear before the learned<\/p>\n<p>Magistrate and seek regular bail.       The     learned counsel for the<\/p>\n<p>petitioners prays that there may be a direction that the same sureties<\/p>\n<p>who have offered bail at the earlier stage may be accepted now also.<\/p>\n<p>That discretion has to be exercised by the learned Magistrate. The<\/p>\n<p>petitioners can raise those contentions before the learned Magistrate. I<\/p>\n<p>have no reason to assume that the learned Magistrate will not consider<\/p>\n<p>such request on merits and in accordance with law.<\/p>\n<p>                                               (R.
