The appellant acknowledged receipt of the copy by\ntwo  letters dated May 5, 1950 May 16, 1950.  On  March\t 30,\n1951, the appellant filed an application in the\t Subordinate\nJudge's\t Court for passing a decree in\tterms of the  award.\nOn  the\t question whether the application was out  of  time,\nbecause, under Art. 178 of the Indian Limitation Act,  1908,\nthe application had to be filed within 90 days of the  date.\nof service of the notice of the making of the award,\n    HELD: Under s. 14(1) of the Arbitration Act, 1940,\twhen\nthe  arbitrators have given their award, they shall sign  it\nand  shall  give notice in writing to the.  parties  of\t the\nmaking\tand  signing thereof and of the amount of  fees\t and\ncharges payable in respect of the arbirtation and the award.\nThe notice need not be in the form of a separate letter.  It\nis  sufficient,\t if it is in writing and  intimates  clearly\nthat the award has been made and signed.  The non-mention of\nthe amount of the fees and charges payable in respect of the\narbitration  and award will not affect the notice as  it  is\nnot  an essential part of it for the purpose of\t limitation.\nIn  the\t present case, since the  appellant  had  sufficient\nnotice\tthat the award had been made and signed when a\tcopy\nof  the\t award\tsigned by the arbitrator  was  sent  to\t the\nappellant, the application for passing a decree in terms  of\nthe award was out of time. Nayar, for the respondent.<br \/>\nThe Judgment of the Court was delivered by<br \/>\n    Hidayatullah, C.J.\tThis is an appeal against a judgment<br \/>\nand  order of the Circuit Bench of the Punjab High Court  at<br \/>\nDelhi<br \/>\n<span class=\"hidden_text\">137<\/span><br \/>\n(Single\t Judge)\t in a matter arising under  the\t Arbitration<br \/>\nAct.  By  ,m agreement dated April 28,\t1948  the  appellant<br \/>\ncompany\t entered into a contract with the Chief Director  of<br \/>\nPurchase (Food) acting on behalf of the Government of India.<br \/>\nIt  is not necessary to give the details of  this  contract,<br \/>\nbecause\t the  matter was referred to  arbitration  under  an<br \/>\narbitration  clause  included in the agreement\tbetween\t the<br \/>\nparties.  The award was made and signed on April 26,   1950.<br \/>\nThe  Arbitrator awarded Rs. 17,080-2-9 with costs in  favour<br \/>\nof  the\t company.  The Arbitrator, however, did not  send  a<br \/>\nnotice\tas such of the making and signing of the  award\t but<br \/>\nsent a copy of the award signed by him to the company.\t The<br \/>\ncompany acknowledged the receipt of this copy by two letters<br \/>\nwhich  are dated May 5 and May 16, 1950. It appears that  in<br \/>\nthe  original  which  was  retained in\tthe  office  of\t the<br \/>\nArbitrator,  it was stated that there was a covering  letter<br \/>\ngiving\tnotice of the making of the award, but\tthe  company<br \/>\ndenied that any such letter had been sent.  However, nothing<br \/>\nmuch turns on it as we shall show presently.<br \/>\n    After the copy of the award was received by the company,<br \/>\nit  filed an application under s. 14(1) of  the\t Arbitration<br \/>\nAct  in the Court of the Subordinate Judge, Delhi  on  March<br \/>\n30,  1951 for making the award ruIe of the court. It may  be<br \/>\nmentioned  that\t on July 3, 1951, the  Arbitrator  sent\t the<br \/>\noriginal  award to the court also.  Before  the\t Subordinate<br \/>\nJudge  objection  was taken by the Union of India  that\t the<br \/>\napplication  of the company to the court was  delayed  since<br \/>\nsuch  an application under s. 14(1) of the  Arbitration\t Act<br \/>\nunder  Art. 178 of the Indian Limitation Act had to be\tmade<br \/>\nwithin 90 days of the receipt of the notice intimating\tthat<br \/>\nthe  award  had\t been  made  and  signed.   This   objection<br \/>\nprevailed  with\t the  Subordinate  Judge  who  rejected\t the<br \/>\napplication.  A revision application was unsuccessfully made<br \/>\nbefore\tthe High Court and it is the order on  the  revision<br \/>\napplication which is the subject of appeal before us.<br \/>\n    Originally\tthe  revision  application  went  before   a<br \/>\nlearned\t Single\t Judge of the High Court.  He  referred\t the<br \/>\nmatter\tto a Division Bench which in its turn  referred\t the<br \/>\ncase for decision to a Full&#8217; Bench.  The Full Bench gave its<br \/>\nopinion\t on  November  17, 1961.  Although  the\t Full  Bench<br \/>\ndiscussed the matter it did not reach any conclusion in\t the<br \/>\ncase, because it felt that whether the application under  s.<br \/>\n14(1) of the Arbitration Act had been made within 90 days or<br \/>\nnot,  was a question of fact which has to be decided by\t the<br \/>\nlearned\t Single Judge, and as the learned Single  Judge\t had<br \/>\nnot  gone into that question, the matter had to go  back  to<br \/>\nhim. When the case came before the learned Single Judge,  he<br \/>\ntook some evidence and examined the question in detail.\t  We<br \/>\nupheld the<br \/>\nSup CI \/70&#8211;1o<br \/>\n<span class=\"hidden_text\">138<\/span><br \/>\ndecision  of  the  Subordinate\tJudge  and   dismissed\t the<br \/>\nrevision application.\n<\/p>\n<p>    It has been argued before us by Mr. B.P. Maheshwari that<br \/>\nthe judgment under appeal is erroneous, because s. 14(1)  of<br \/>\nthe  Arbitration Act requires that there should be a  notice<br \/>\nin  writing and that notice had to be something besides\t the<br \/>\naward  of which a copy had been sent. He has cited a  number<br \/>\nof  rulings  in support of his contention that a  notice  in<br \/>\nwriting\t is  incumbent\tbefore limitation under Art. 178  of<br \/>\nthe Limitation Act which applies to Art. 14(1) petitions can<br \/>\nstart.\t In chief, he relies upon Ratnawa  v.  Gurishiddappa<br \/>\nGurushantappa  Magavi  &amp;  Ors. ( 1 ),\tPuppalla  Ramulu  v.<br \/>\nNagidi\tAppelaslwami &amp; Ors.(2), Jagdish v. Sunder(3),  <a href=\"\/doc\/1535557\/\">Ganga<br \/>\nRam  v. Radha Kishan<\/a>(4), Badaria Ramakrishnarnma &amp;  Ors.  v.<br \/>\nVattikonda Lakshmibayamma &amp; Ors.(5).\n<\/p>\n<p>    It is not necessary to go into the reasoning which\tmade<br \/>\nthe  learned  Judges in these cases to lay down\t that  there<br \/>\nmust  be  a proper notice in writing of the  making  of\t the<br \/>\naward.\t That follows in fact from the words of s. 14(1)  of<br \/>\nthe  Arbitration  Act.\tThat  section  says  that  when\t the<br \/>\narbitrators  or\t umpire have given their award,\t they  shall<br \/>\nsign  it and shall give notice in writing to the parties  of<br \/>\nthe making and signing thereof and of the amount of fees and<br \/>\ncharges\t payable  in respect of the arbitration\t and  award.<br \/>\nWhat  will be considered a sufficient notice in\t writing  of<br \/>\nthe  making and signing of the award is a question of  fact.<br \/>\nIn the cited cases emphasis sometimes has been laid upon the<br \/>\nlatter part of the sub-section which speaks of the amount of<br \/>\nfees  and charges payable in respect of the arbitration\t and<br \/>\naward.\tSometimes emphasis has been placed upon the  opening<br \/>\nwords  namely  that  there should be a\tnotice\tin  writing.<br \/>\nReading\t the  word &#8216;notice&#8217; as we generally do,\t it  denotes<br \/>\nmerely an intimation to the party concerned of a  particular<br \/>\nfact.  It seems to us that we cannot limit the words &#8220;notice<br \/>\nin  writing&#8221;  to  only a letter.  Notice  may  take  several<br \/>\nforms.\t It must, to be sufficient, be in writing  and\tmust<br \/>\nintimate  quite\t clearly that the award has  been  made\t and<br \/>\nsigned.\t In the present case, a copy of the award signed  by<br \/>\nthe  arbitrator was sent to the company.  It appears  to  us<br \/>\nthat  the company had sufficient notice that the  award\t had<br \/>\nbeen made and signed.  In fact the two letters of May 5\t and<br \/>\nMay 16 to which we have referred quite clearly show that the<br \/>\ncompany\t knew  full well that the arbitrator had  given\t the<br \/>\naward,\tmade  it and signed it.\t In these  circumstances  to<br \/>\ninsist\tupon  a letter which perhaps was also  cent  (though<br \/>\nthere is some doubt about it) is to refine the law<br \/>\n  (1) A.I.R. 1962 Mysore 135.\t       (2) A.I.R. 1957\tA.P.\n<\/p>\n<p>11.<br \/>\n  (3)  I.L.R.  27 Pat. 86.\t\t (4)  I.L.R.  [1955]<br \/>\nPunj. 402.\n<\/p>\n<p>(5) I.L.R. [1958] A.P. 166.\n<\/p>\n<p><span class=\"hidden_text\">139<\/span><\/p>\n<p>beyond\tthe legitimate requirements.  The only omission\t was<br \/>\nthat  there  was  no notice of the amount of  the  fees\t and<br \/>\ncharges\t payable in respect of arbitration and\taward.\t But<br \/>\nthat was not an essential part of the notice for the purpose<br \/>\nof  limitation.\t To emphasise the latter part as  being\t the<br \/>\nessential  part\t of  the notice is to make  the\t first\tpart<br \/>\ndepend\tupon the determination of the fees and\tcharges\t and<br \/>\ntheir  inclusion  in the notice.  A written  notice  clearly<br \/>\nintimating  the\t parties concerned that the award  had\tbeen<br \/>\nmade and signed, in our opinion certainly starts limitation.<br \/>\n    In this view of the matter we are in agreement with\t the<br \/>\ndecision  of the learned Single Judge who has  endorsed\t the<br \/>\nopinion\t of the Subordinate Judge that limitation  began  to<br \/>\nrun  from  the receipt of the copy of the  award  which\t was<br \/>\nsigned\tby the Arbitrator and which gave due notice  to\t the<br \/>\nparty  concerned  that the award had been made\tand  signed.<br \/>\nThat is how the party itself understood when it acknowledged<br \/>\nthe  copy  sent to it.\tTherefore, the application  must  be<br \/>\ntreated\t as being out of time and the decision of  the\tHigh<br \/>\nCourt to so treat it was correct in all the circumstances of<br \/>\nthe case.\n<\/p>\n<p>    We,\t therefore,  do not see any reason to  interfere  in<br \/>\nthis appeal and it is dismissed.  But we make it clear\tthat<br \/>\nthe other part of the case, namely what is to happen to\t the<br \/>\naward sent by the Arbitrator himself to the court has yet to<br \/>\nbe  determined\tand  what we say here will  not\t affect\t the<br \/>\ndetermination  of  that\t question.   Obviously\tenough\tthat<br \/>\nmatter arises under the second subsection of s. 14 and\twill<br \/>\nhave to be considered quite apart from the application\tmade<br \/>\nby the company to have the award made into rule of Court.<br \/>\n    It\twas  represented  to us by Dr.\tSyed  Mohammad\tthat<br \/>\nobjections  had been taken to the validity of the award\t and<br \/>\nthey  remain still for decision.  Those of course must\tfall<br \/>\nto the ground with the application which we have found to be<br \/>\nout of time.  As to whether similar objections can be raised<br \/>\nin  answer  to\tthe  award filed  at  the  instance  of\t the<br \/>\narbitrator  is\ta question which we cannot go  into  in\t the<br \/>\npresent\t appeal\t and  no  expression  of  opinion  must\t  be<br \/>\nattributed to us on that point.\t In the circumstances of the<br \/>\ncase we leave the parties to bear their own costs.\n<\/p>\n<pre>V.P.S.\t\t\t\t\t   Appeal dismissed.\n<span class=\"hidden_text\">140<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Parasramka Commercial Company vs Union Of India on 29 August, 1969 Equivalent citations: 1970 AIR 1654, 1970 SCR (2) 136 Author: M Hidayatullah Bench: Hidayatullah, M.
