No.471 of 2004\n    ------------------------------------------------\n       Dated this the 14th day of July, 2010\n\n                    JUDGMENT\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>       The claimants are in appeal. The case<\/p>\n<p>pertains to acquisition of land in Nellikode village<\/p>\n<p>for   the   purpose    of    Calicut   byepass.     The<\/p>\n<p>notification was published on 24\/01\/98. The Land<\/p>\n<p>Acquisition Officer awarded a total compensation<\/p>\n<p>of Rs.1,20,855\/-. The Reference Court, however,<\/p>\n<p>would re-fix the land value on the basis of the<\/p>\n<p>evidence to Rs.45,000\/-. The Reference Court<\/p>\n<p>would     award    a   sum     of    Rs.10,000\/-     as<\/p>\n<p>compensation for injurious affection finding that<\/p>\n<p>about &lt; cents of land was unauthorisedly affected<\/p>\n<p>almost completely.\n<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.471 of 2004          -2-<\/span><\/p>\n<p>             2. In this appeal various grounds have been<\/p>\n<p>      raised and Sri.R.Sudhish, the learned counsel for<\/p>\n<p>      the appellants addressed us on the basis of<\/p>\n<p>      various      grounds.  All    the  submissions    of<\/p>\n<p>      Sri.Sudhish      were resisted by Smt.Latha T.<\/p>\n<p>      Thankappan, the learned senior Government<\/p>\n<p>      Pleader. We have considered the submissions. We<\/p>\n<p>      keep in mind our own judgment in LAA.1045\/08<\/p>\n<p>      wherein we fixed the value of identical land which<\/p>\n<p>      was slightly superior at Rs.55,500\/-. We are of the<\/p>\n<p>      view that on the basis of the judgment we have<\/p>\n<p>      passed in LAA.1045\/08 there is justification for re-<\/p>\n<p>      fixing the value of land in this case also at<\/p>\n<p>      Rs.55,500\/- . It is accordingly re-fixed. On the<\/p>\n<p>      basis of the above re-fixation, the appellants will<\/p>\n<p>      be eligible for award of a further amount of<\/p>\n<p>      Rs.5,000\/-       as  additional  compensation    for<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.471 of 2004         -3-<\/span><\/p>\n<p>      injurious     affection. Even though Sri.Sudhish<\/p>\n<p>      argued that additional compensation should be<\/p>\n<p>      awarded for building also, we are not inclined to<\/p>\n<p>      accept the above argument since there is nothing<\/p>\n<p>      on record which will show that any valuable<\/p>\n<p>      building      existing  on   the   property  under<\/p>\n<p>      acquisition.\n<\/p>\n<p>             3. The appeal is allowed to the above extent<\/p>\n<p>      only. The appellants will be entitled for all<\/p>\n<p>      statutory benefits. The appellants will also be<\/p>\n<p>      entitled for proportionate interest.<\/p>\n<p>                                      PIUS C.
