BLOCK SUPPLY OFFICER HARLAKHI AND MADHEPUR BLOCK,\n         DISTT.- MADHUBANI\n                                       -----------\n<\/pre>\n<p>2.   6.12.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The petitioner, a P.D.S. licensee, is aggrieved<\/p>\n<p>                 by the order dated 9.8.2008, cancelling his licence for<\/p>\n<p>                 alleged violations of the terms and conditions as<\/p>\n<p>                 affirmed in appeal on 20.6.2009.\n<\/p>\n<p>                              Learned counsel for the petitioner fairly<\/p>\n<p>                 acknowledges that two persons have deposed during<\/p>\n<p>                 inquiry that the petitioner was distributing two litres<\/p>\n<p>                 instead of three litres of Kerosene Oil.         If that be<\/p>\n<p>                 correct, this Court cannot go into the sufficiency of the<\/p>\n<p>                 evidence in exercise of its power of judicial review.<\/p>\n<p>                 The Court shall only see whether there is evidence or<\/p>\n<p>                 do the findings suffer from perversity.       On the own<\/p>\n<p>                 showing of the petitioner, the findings did not suffer<\/p>\n<p>                 from any perversity.\n<\/p>\n<p>                              The second ground was that the shop was<\/p>\n<p>                 found closed on the date of inspection.<\/p>\n<p>                              Reliance is placed on a decision reported in<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>1996(2) PLJR 53, to submit that cancellation of the<\/p>\n<p>licence    for    one       day     closure   was    too   harsh   a<\/p>\n<p>punishment.\n<\/p>\n<p>           The Court in exercise of its power of judicial<\/p>\n<p>review is primarily concerned with the decision<\/p>\n<p>making process and not the final decision itself unless<\/p>\n<p>it   suffers     from       grave    arbitrariness,    illogical   or<\/p>\n<p>perversity.      The petitioner acknowledges that he did<\/p>\n<p>not produce any evidence before the S.D.O. or the<\/p>\n<p>Collector in support of his plea that on the date of<\/p>\n<p>inspection he had gone to the State Bank for<\/p>\n<p>preparation of a Bank draft which was deposited the<\/p>\n<p>same day in the Block Development Office. If that be<\/p>\n<p>so, the petitioner has only to blame himself for the<\/p>\n<p>findings of the authority that his explanation on that<\/p>\n<p>account was not acceptable.\n<\/p>\n<p>           Counsel for the State rightly submits that<\/p>\n<p>whether the punishment was excessive or not should<\/p>\n<p>be left to the authorities to decide.<\/p>\n<p>           The petitioner is stated to be an agent of the<\/p>\n<p>State     Government          for     distribution    of   essential<\/p>\n<p>commodities to the down trodden Section of society.<\/p>\n<p>The agency is governed by a statutory relationship. It<\/p>\n<p>shall be primarily for the Principal to decide if he<\/p>\n<p>wants to continue with the services of the agent or<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>           not.\n<\/p>\n<p>                    The impugned order therefore calls for no<\/p>\n<p>           interference   by       the   Court   in   exercise   of   writ<\/p>\n<p>           jurisdiction. To that extent, the writ application is<\/p>\n<p>           dismissed.\n<\/p>\n<p>                    Notwithstanding the dismissal of the writ<\/p>\n<p>           application, if the petitioner represents on the ground<\/p>\n<p>           that the punishment was excessive not commensurate<\/p>\n<p>           with the charges against him, nothing precludes the<\/p>\n<p>           respondents from considering matters in their own<\/p>\n<p>           wisdom in accordance with law, preferably without<\/p>\n<p>           undue delay.\n<\/p>\n<\/p>\n<pre>P.
