{"id":10058,"date":"2011-09-23T00:00:00","date_gmt":"2011-09-22T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/pushpa-devi-vs-the-state-of-bihar-on-23-september-2011"},"modified":"2018-10-01T21:34:52","modified_gmt":"2018-10-01T16:04:52","slug":"pushpa-devi-vs-the-state-of-bihar-on-23-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/pushpa-devi-vs-the-state-of-bihar-on-23-september-2011","title":{"rendered":"Pushpa Devi vs The State Of Bihar on 23 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Pushpa Devi vs The State Of Bihar on 23 September, 2011<\/div>\n<pre>                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Criminal Miscellaneous No.31717 of 2011\n                           Pushpa Devi, wife of Sikender Prasad\n                                              Versus\n                                     The State Of Bihar\n                                  ----------------------------------\n<\/pre>\n<p>2.   23.09.2011               Heard learned counsel for the petitioner and the State.<\/p>\n<p>                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 302 and 201 of the Indian Penal Code.<\/p>\n<p>                               It has been submitted that the petitioner is the wife of<\/p>\n<p>                  the deceased and her name transpired during investigation from<\/p>\n<p>                  the confessional statement of the co-accused that she hatched a<\/p>\n<p>                  conspiracy for the murder of her husband.\n<\/p>\n<p>                            Considering the aforesaid, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs. 5,000\/-<\/p>\n<p>                  (Five thousand) with two sureties of the like amount each or any<\/p>\n<p>                  other surety to be fixed by the court concerned to the satisfaction<\/p>\n<p>                  of Additional Sessions Judge-IV, Gaya, in connection with<\/p>\n<p>                  Sessions Trial No. 21 of 2011 arising out of Sherghati P.S. Case<\/p>\n<p>                  No. 148 of 2010, subject to the following conditions: (i) That one of<\/p>\n<p>                  the bailors will be a close relative of the petitioner who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner. The bailor will also undertake to inform the Court if there<\/p>\n<p>                  is any change in the address of the petitioner. (ii) That the affidavit<\/p>\n<p>                  shall clearly state that the petitioner is not an accused in any other<\/p>\n<p>                  case and if he is he shall not be released on bail. (iii) That the<\/p>\n<p>                  bailor shall also state on affidavit that he will inform the court<\/p>\n<p>                  concerned if the petitioner is implicated in any other case of similar<\/p>\n<p>                  nature after his release in the present case and thereafter the court<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        below will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>        bail on the ground of misuse. (iv) That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given date<\/p>\n<p>        and be present on date fixed for charge and if he fails to do so on<\/p>\n<p>        two given dates and delays the trial in any manner, his bail will be<\/p>\n<p>        liable to be cancelled for reasons of misuse.
