I-246\/2010 registered at Adalaj<br \/>\nPolice Station,<br \/>\nDist. Gandhinagar. In the said FIR the complainant has made serious<br \/>\nallegations of fraud and forgery in land deal. It is stated, inter<br \/>\nalia, that the applicants along with other co-accused have sold his<br \/>\nland, for which they have no right, title or interest, knowing fully<br \/>\nwell that the land is already sold over to the grandfather of the<br \/>\ncomplainant, only because the land price is appreciated multi fold,<br \/>\npresently the price could be assessed at Rs.5 crores, they executed<br \/>\nanother document in favour of accused No.8 by showing the sale<br \/>\nconsideration of Rs.24 lac only.\n<\/p>\n<p>\tIn<br \/>\nface of such serious allegations, I am of the opinion that custodial<br \/>\ninterrogation of the applicants would be necessary. Counsel for the<br \/>\napplicants, however, vehemently contended that it is purely civil<br \/>\ndispute and anticipatory bail should be granted to the applicants. He<br \/>\nrelied upon a decision of the Apex Court in case of  Ravindra<br \/>\nSaxena Vs. State of Rajasthan, 2010 (1) G.L.H. 382 and in<br \/>\nparticular on the observations made in Paragraph No.11, which read as<br \/>\nunder:\n<\/p>\n<p>\t&#8220;11.\tIn<br \/>\nour opinion, the High Court erred in not considering the application<br \/>\nfor anticipatory bail in<br \/>\naccordance with law.\n<\/p>\n<p>\tThe defence put forward<br \/>\nby the appellant cannot be obliterated at this stage itself. We are<br \/>\nalso of the opinion, that the submission of the learned Counsel for<br \/>\nthe appellant that the dispute herein is purely of a civil nature<br \/>\ncannot be brushed aside at this stage. We, therefore, grant<br \/>\nanticipatory bail to the<br \/>\nappellant in the case pending on the basis of FIR No.107\/2007<br \/>\nregistered at Police Station<br \/>\nVidhyadhar Nagar, Jaipur City under Section 420, 467, 468, 120-B IPC<br \/>\nnow pending only under Section 420 and 120-B IPC. It is directed that<br \/>\nin the event of arrest the appellant shall be released on bail to the<br \/>\nsatisfaction of the Investigating Officer. It is also directed that<br \/>\nthe appellant shall join investigation as and when required.&#8221;\n<\/p>\n<p>\tIn<br \/>\nthe present case, however, it cannot be stated that the dispute is<br \/>\none of the purely civil nature.
