Justice V.GIRI\n\n Dated :19\/11\/2008\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n                 W.P.(C).34124\/2008\n                     --------------------\n     Dated this the 19th day of November, 2008\n\n                     JUDGMENT\n<\/pre>\n<p>     The petitioner, who claims to have been born on<\/p>\n<p>14.10.1984, which fact,         according to     him,   is<\/p>\n<p>evidenced by Ext.P1 the certificate issued by the<\/p>\n<p>Registrar of Births &amp; Deaths, Thiruvalla Municipality,<\/p>\n<p>is aggrieved by the incorrect date of birth as entered in<\/p>\n<p>his passport as evidenced by Ext.P4.             He then<\/p>\n<p>approached the second respondent for correction of<\/p>\n<p>date of birth in Ext.P4. Apparently, he was asked to<\/p>\n<p>get declaratory order from the           Court. Petitioner<\/p>\n<p>submits that as per the recent circular issued by the<\/p>\n<p>Central Government on 24.10.2007, the declaratory<\/p>\n<p>order from the Court is not always necessary where<\/p>\n<p>the concerned competent officer itself is in a position<\/p>\n<p>to verify whether there is any defect and then take<\/p>\n<p>appropriate action        thereon.        Learned counsel<\/p>\n<p>appearing on behalf of the respondents submits that<\/p>\n<p>going by the recent circular, such powers are available<\/p>\n<p>to the second respondent.\n<\/p>\n<p>W.P.(C).34124\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>2.
