No.3598\/1997\n\n        Kesha Ram Patel v. State of Rajasthan &amp; others\n\nDate of Order<\/a>: 18th February, 2009\n\n          HON'BLE MR JUSTICE GOVIND MATHUR\n\n\nNone present for the petitioner\nNone present for respondents\n\n\n\n     After   completing   training   relating   to     multi-purpose\n\nworkers, petitioner was employed as Multi-purpose Worker\n\nunder an order dated 19th January, 1991 passed by the Chief\n\nMedical &amp; Health Officer, Jodhpur. By the same order, posting\n\nwas given to the petitioner at Primary Health Center, Kakelao\n\n(Salawas), Jodhpur.\n\n\n\n     As per averments made in the petition for writ, petitioner\n\nremained absent from duties somewhere in 1991 due to acute\n\nillness and after getting fit, he reported on 15th June, 1994 to\n\nresume the duties. However, he was not allowed to do so. No\n\naction was taken by the respondents for pretty long time,\n\ntherefore, a notice for demand of justice was also given by the\n\npetitioner to respondents through his counsel on 18th November,\n\n1996. On failing to get any favour from the respondents' corner,\n\nthis petition for writ was preferred by the petitioner seeking a\n\ndirection for respondents to allow him to resume the duties.\n                                                    SBCWP No.3598\/97\n                                                                  2\n\n      In reply to the writ petition, it is stated by the respondents\n\nthat the petitioner, after drawing salary on 05th August, 1991\n\nwith respect to period from January, 1991 to June, 1991; did not\n\nchoose to report on duties though a bond was executed by him\n\nat the time of initial appointment that he will work with the\n\nrespondents for a period of five years. As per respondents, the\n\npetitioner never applied for any medical leave and no joining\n\nreport was submitted by him on 15th June, 1994 as stated in the\n\npetition. The respondents, in quite unambiguous terms stated\n\nthat the document dated 15th June, 1994 (Annx.1) is a forged\n\none. The stand of the respondents is that, as a matter of fact,\n\npetitioner abandoned the service and as such, the instant one is\n\nnot a case of absence but of abandonment from service. No\n\nrejoinder to the reply filed on behalf of respondents is submitted\n\nby the petitioner.\n\n\n\n      Precisely, the question that requires adjudication is that\n\nwhether the petitioner remained absent from duties due to his\n\nailment or he abandoned the service?\n\n\n\n      The petitioner has not placed any document on record to\n\nsubstantiate the fact averred in the writ petition that he\n\nremained absent from duties due to illness and for that he\n\nsubmitted an application. In entire petition for writ, not a single\n                                                     SBCWP No.3598\/97\n                                                                   3\n\nword regarding nature of petitioner's ailment is referred. The\n\npetitioner has placed on record copy of joining report dated 15th\n\nJune,    1994,   genuineness    of   which   is   disputed   by   the\n\nrespondents. Even after receiving reply to the writ petition,\n\npetitioner did not choose to place on record any evidence to\n\nsubstantiate the contention that he was suffering from such an\n\nailment that prevented him from report on duties for years\n\ntogether. Nothing is stated by the petitioner regarding allegation\n\nof the respondents that the document Annx.1 dated 15th June,\n\n1994 is forged one.\n\n        In the factual background above, a valid inference can be\n\ndrawn that the petitioner abandoned the service and after lapse\n\nof substantial period, he want to convert the same as absence\n\nfor the reasons beyond his control. I do not find any bona fide on\n\nthe part of petitioner to claim his absence from duties as genuine\n\none. The petitioner, as a matter of fact, abandoned the service.\n\nTherefore, respondents rightly did not allow him to resume\n\nduties as claimed in the notice for demand of justice submitted\n\non behalf of petitioner.\n\n        For the reasons stated above, I do not find any merit in\n\nthis petition for writ.
