\n           These   writ    petitions     are     filed   aggrieved by   the<\/p>\n
rearrangement of the rank list prepared for admission to the M.Sc.<\/p>\n
Degree course in Nursing.       In the prospectus as approved by the<\/p>\n
Government, in paragraph 7.4 it was stipulated that all candidates<\/p>\n
under general merit shall have to secure 50% marks in the entrance<\/p>\n
examination    conducted      by     the    Commissioner       for Entrance<\/p>\n
Examinations, Kerala.     As regards scheduled caste\/scheduled tribe<\/p>\n
candidates the stipulation was that they shall have to secure 40% in<\/p>\n
the entrance examination.          After the rank list was prepared, the<\/p>\n
Government issued G.O. (Rt.) No.2776\/H&FWD dated 25.9.2009<\/p>\n
modifying the terms of paragraph 7.4 of the prospectus.                The<\/p>\n
stipulation regarding cut off marks was dispensed with. These writ<\/p>\n
petitions were thereupon filed challenging the said Government order<\/p>\n
and the alteration of the rank based on the Government order dated<\/p>\n

      2. When this writ petition came up for hearing today,<\/p>\n
Sri.P.Narayanan, the learned Government Pleader appearing for the<\/p>\n
respondents submitted that the Government have by G.O. (Rt.)<\/p>\n
No.3332\/09\/H&FWD        Dated      16.11.2009   cancelled    the   G.O.<\/p>\n
No.2776\/H&FWD dated 25.9.2009 and restored paragraph 7.4 of the<\/p>\n
prospectus. A copy of the Government order was made available to<\/p>\n
me and the same is incorporated in the records. In view of the G.O.<\/p>\n
dated 16.11.2009, the petitioners cannot have any subsisting<\/p>\n
grievance.   The Government have in the order dated 16.11.2009<\/p>\n
directed the Commissioner for Entrance Examinations to revive and<\/p>\n
publish the rank list originally prepared by him based on the<\/p>\n
unamended stipulation in the prospectus and also to fill up seats in the<\/p>\n
manner suggested therein. In such circumstances, no further orders<\/p>\n
are called for in these writ petitions. They are accordingly closed with<\/p>\n
a direction to the Commissioner for Entrance Examinations to act as<\/p>\n
directed by the Government in the G.O. dated 16.11.2009.<\/p>\n
