JUSTICE BIRENDRA PRASAD VERMA\n\n                  ORAL ORDER<\/pre>\n<p>                  (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>3.   08-07-2011                   This Appeal preferred under Clause 10 of the Letters<br \/>\n                  Patent arises from the judgment and order dated 11 th April 2011<br \/>\n                  passed by the learned single Judge in above CWJC No. 6501 of<br \/>\n                  2011.\n<\/p>\n<p>                                  The learned Single Judge has rejected the challenge<br \/>\n                  to the notice dated 4th April 2011 issued by the Executive Officer,<br \/>\n                  Nagar Parishad, Motihari in respect of no confidence motion<br \/>\n                  moved against the appellant-writ petitioner, the Deputy Chief<br \/>\n                  Councillor of Nagar Parishad.\n<\/p>\n<p>                                  Learned advocate Mr. Mrigank Mauli has appeared<br \/>\n                  for the appellant. He admits that since the dismissal of the writ<br \/>\n                  petition no confidence motion against the appellant has been<br \/>\n                  passed by the Nagar Parishad. Consequently, the appellant has<br \/>\n<span class=\"hidden_text\">           Patna High Court LPA No.939 of 2011 (3) dt.08-07-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                     2<\/span><\/p>\n<p>                       been removed from the office of the Deputy Chief Councillor.\n<\/p>\n<p>                                        In view of the above development, the present<br \/>\n                       Appeal has become infructuous.\n<\/p>\n<p>                                        If aggrieved, the appellant may challenge the order of<br \/>\n                       removal passed against him before appropriate forum. The order<br \/>\n                       may also be challenged on the grounds raised in the present<br \/>\n                       Appeal.\n<\/p>\n<p>                                        We clarify that we have not examined the correctness<br \/>\n                       of the judgment of the learned single Judge or the question<br \/>\n                       whether or not the Executive Officer was competent to give notice<br \/>\n                       of no confidence motion.\n<\/p>\n<p>                                        Subject to the above observations, the Appeal is<br \/>\n                       disposed of.<\/p>\n<pre>\n\n\n\n                                                      (R.M.
