DAVE\n\t\t\n\t\n\n \n\nDate\n: 01\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p>Learned APP, waives service of notice of rule on behalf of the<br \/>\nrespondent-State.\n<\/p>\n<p>1.\t\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered at<br \/>\nC.R. No. I &#8211; 174 of 2010 with Gorva Police Station, Vadodara<br \/>\nfor the offences punishable under Sections 302, 323, 504 and 114 etc.<br \/>\nof the Indian Penal Code and under Section 135 of the Bombay Police<br \/>\nAct.\n<\/p>\n<p>2.\t\tHeard<br \/>\nlearned Counsel for the parties and perused the material on record.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel appearing for the applicant submits that charge-sheet is<br \/>\nfiled and as the co-accused are enlarged on bail by this Court, the<br \/>\napplicant may be enlarged on bail.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned counsel for the parties and considering overall facts<br \/>\nand circumstances of the case, he deserves to be enlarged  on bail.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith First Information Report registered at C.R. No.I &#8211;<br \/>\n174 of 2010 with GORVA POLICE STATION,<br \/>\nVadodara, on executing bond of Rs.5,000\/- [Rupees Five Thousand Only]<br \/>\nwith one surety of the like amount to the satisfaction of the trial<br \/>\nCourt and subject to the conditions that he shall;\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender his<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tmark presence at the<br \/>\nconcerned Police Station on the first Sunday of every month between<br \/>\n10.00 a.m and 3.00 p.m for three months only;\n<\/p>\n<p>(f)\tfurnish the present<br \/>\naddress of residence to the Investigating Officer and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>6.\t\tThe<br \/>\nAuthorities will release the applicant only of she is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>7.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\t\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>10.\t\tRule<br \/>\nis made absolute to the aforesaid extent.
