Shah waives service of notice of Rule for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.15\/2011 with Vadali Police Station, Sabarkantha for the<br \/>\n\toffences punishable under Sections 436, 147, 148, 504, 427 of Indian<br \/>\n\tPenal Code and under Section 135 of the B.P. Act.\n<\/p>\n<p>Learned<br \/>\n\tCounsel Mr. J.V. Japee appearing for the applicants submit that<br \/>\n\twithout prejudice to the rights and contentions of the applicants to<br \/>\n\tbe decided at a proper stage and without admitting anything on<br \/>\n\tmerits, on instruction submit that prima facie, when the<br \/>\n\tinvestigation is on verge of completion and the applicants are<br \/>\n\tfarmers who have to reap the crops in their fields, by imposing<br \/>\n\tsuitable conditions, they may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mr. J.K. Shah for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicants, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicants on bail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.15\/2011 with<br \/>\n\tVadali Police Station, Sabarkantha, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) each with one surety of the<br \/>\n\tlike amount to the satisfaction of the Trial Court and subject to<br \/>\n\tthe conditions that they shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of their residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicants only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
