     Petitioner is an employee in Southern railway. The<\/p>\n
issue pertains to proceedings initiated under the<\/p>\n
Securitisation and Reconstruction of Financial Assets and<\/p>\n
Enforcement of Security Interest Act, 2002 (SARFAESI<\/p>\n
Act) against the petitioner with respect to default<\/p>\n
committed in repayment of a housing loan availed from<\/p>\n
the first respondent Bank. It is stated that the petitioner<\/p>\n
is residing along with his wife and two children in a house<\/p>\n
which is partly completed construction. The amount in<\/p>\n
question was availed for the construction of the<\/p>\n
residence.   According to the petitioner eventhough an<\/p>\n
amount of Rs.2,62,876\/- was sanctioned the first<\/p>\n
respondent had disbursed only a sum of Rs.1,50,000\/-.<\/p>\n
Since the roofing of the building could not be completed,<\/p>\n
the petitioner is using the same for residential purpose by<\/p>\n
installing temporary roofing. It is further stated that the<\/p>\n

petitioner’s wife is critically ill due to severe heart disease<\/p>\n
and was advised to undergo an emergent heart surgery.<\/p>\n
      2.    Pursuant to steps initiated under the SARFAESI<\/p>\n
Act, the respondent had taken over possession of the<\/p>\n
residential property on 15.12.2010 and the petitioner as<\/p>\n
well as his family members are now evicted from the house.<\/p>\n
It is stated that the petitioner has no other place to reside<\/p>\n
and that the family is on the street. Hence this Writ Petition<\/p>\n
is filed seeking direction to permit re-occupation of the<\/p>\n
petitioner on the basis that the petitioner will pay off the<\/p>\n
defaulted amount in the loan account within a short time,<\/p>\n
and also seeking direction to the first respondent to permit<\/p>\n
regularisation of the loan account in question.<\/p>\n
      3.    Heard, learned standing counsel appearing for<\/p>\n
the first respondent Bank. It is submitted that the loan in<\/p>\n
question was sanctioned in the year 2005 but still the<\/p>\n
petitioner failed to avail the loan and the amount as stated<\/p>\n
above was released payment only in the year 2006. The<\/p>\n

petitioner had not cared to make payment of the monthly<\/p>\n
instalments after availing the loan and the arrears itself has<\/p>\n
now accrued to the tune of around Rs.1.80 lakhs.            It is<\/p>\n
further submitted that the total balance outstanding is more<\/p>\n
than Rs.2.83 lakhs.\n<\/p>\n
     4.     According      to   the    first  respondent,     the<\/p>\n
dispossession was effected after issuing repeated demands<\/p>\n
and even the Advocate Commissioner appointed by the<\/p>\n
Chief Judicial Magistrate Court had visited the property on<\/p>\n
several occasions demanding the petitioner to hand over<\/p>\n
possession of the premises. Since the loan account is in<\/p>\n
chronic default and huge arrears is due, the first<\/p>\n
respondent Bank is not favouring to show indulgence in<\/p>\n
permitting to re-occupy the house.\n<\/p>\n
     5.     It is noticed that the petitioner has not availed any<\/p>\n
of the statutory remedies against the proceedings initiated<\/p>\n
under the SARFAESI Act. I find no merit in the contentions<\/p>\n
raised warranting interference with the proceedings in any<\/p>\n

manner.       However, learned counsel for the petitioner<\/p>\n
submitted that the petitioner is not intending to pursue any<\/p>\n
of the remedies under the statute and that he is<\/p>\n
relinquishing all challenges against the proceedings. On<\/p>\n
the other hand a limited prayer is made to permit re-<\/p>\n
occupation of the building in question for the purpose of<\/p>\n
residence of himself and his family subject to condition of<\/p>\n
the petitioner remitting the entire amounts in default within<\/p>\n
a short period and further to direct the first respondent to<\/p>\n
regularise the account by permitting the petitioner for<\/p>\n
payment of the future monthly instalments on a regular<\/p>\n
basis.\n<\/p>\n
     6.     Having    considered    the     special   factual<\/p>\n
circumstances prevailing in this case, I am of the view that<\/p>\n
eventhough interference on merits is not possible, some<\/p>\n
indulgence can be shown in permitting the petitioner to<\/p>\n
occupy the building for the purpose of residence of his<\/p>\n
family subject to stringent conditions to be imposed.<\/p>\n

     7.     Under the above circumstances, the Writ Petition<\/p>\n
is disposed of directing the first respondent to permit the<\/p>\n
petitioner to occupy the residential building in the property<\/p>\n
which was already taken over possession, for the purpose of<\/p>\n
residence of himself and his family, without prejudice to the<\/p>\n
legal possession being retained by the first respondent<\/p>\n
Bank, subject to condition of the petitioner remitting a sum<\/p>\n
of Rs.50,000\/- on or before 15.01.2011.<\/p>\n
     8.     The petitioner shall pay the entire arrears in the<\/p>\n
loan account (defaulted instalments along with interest and<\/p>\n
expenses if any due) in 3 (three) equal monthly instalments,<\/p>\n
falling due on or before 15.02.2011 and on or before the<\/p>\n
15th day of the two succeeding months thereafter.         The<\/p>\n
petitioner shall also make payment of the regular instalment<\/p>\n
due with respect to the months concerned, along with the<\/p>\n
above said payments.\n<\/p>\n
     9.     If payment of the defaulted amount is regularised<\/p>\n
as directed above, the respondent shall permit the<\/p>\n

petitioner to continue payment of the future monthly<\/p>\n
instalments in accordance with the original schedule of<\/p>\n
repayment.\n<\/p>\n
     10. It is made clear that on the event of default in<\/p>\n
complying with any of the stipulations herein above<\/p>\n
contained, the respondent will be free to evict the petitioner<\/p>\n
or anybody else who is in occupation of the building,<\/p>\n
without recourse to any legal proceedings, if necessary with<\/p>\n
the assistance of police authorities having jurisdiction on<\/p>\n
the local area.\n<\/p>\n
     11. It is made clear that the petitioner is precluded<\/p>\n
from raising any challenge with respect to any such action<\/p>\n
for eviction by approaching this Court or any other legal<\/p>\n
Forum.\n<\/p>\n<\/p>\n
