THE DISTRICT EDUCATION OFFICER, GOPALGANJ\n                                      -----------\n<\/pre>\n<p>3   19\/04\/2011             This writ application has been filed by the<\/p>\n<p>                   petitioner for a direction upon the respondents to<\/p>\n<p>                   consider his case for granting promotion on the post of<\/p>\n<p>                   Headmaster keeping in view his long service, training<\/p>\n<p>                   and experience. Claim of the petitioner is that he belongs<\/p>\n<p>                   to Bind Caste (Mallah), a resident of Uttar Pradesh and is<\/p>\n<p>                   a Scheduled Caste. He claims that he ought to be given<\/p>\n<p>                   promotion against vacancies existing in the reserved<\/p>\n<p>                   category, if not in the general category.\n<\/p>\n<p>                           Stand of the State in the counter affidavit is that<\/p>\n<p>                   the petitioner may be a Scheduled Caste in the State of<br \/>\n<span class=\"hidden_text\">                   -2-<\/span><\/p>\n<p>Uttar Pradesh but he cannot carry that status in the State<\/p>\n<p>of Bihar since such a caste is not notified to be a<\/p>\n<p>Scheduled Caste within the State of Bihar. So far as the<\/p>\n<p>petitioner is concerned as there is no dispute on this issue<\/p>\n<p>in view of not only the notification of the State of Bihar<\/p>\n<p>but also the various decisions which have come to be<\/p>\n<p>rendered in such disputes by this Court. Some such order<\/p>\n<p>is annexure to the counter affidavit of the State.<\/p>\n<p>        If that is the stand of the State, then obviously<\/p>\n<p>the petitioner cannot claim benefit of promotion under<\/p>\n<p>the reserved category of Scheduled Caste but whether the<\/p>\n<p>petitioner has a right of promotion based on his seniority<\/p>\n<p>position in terms of the gradation list is yet another issue.<\/p>\n<p>The statement made at the Bar on behalf of the petitioner<\/p>\n<p>is that many a persons above the petitioner have already<\/p>\n<p>begotten benefit of promotion and he too is in line.<\/p>\n<p>        It goes without saying that the moment the turn<\/p>\n<p>of the petitioner comes for consideration for promotion<\/p>\n<p>and if he fulfills all other requirements, then his case may<\/p>\n<p>be considered on merit but so far as the benefit under<\/p>\n<p>reserved category is concerned, the Court is in agreement<\/p>\n<p>with the stand of the State that the petitioner cannot jump<br \/>\n<span class=\"hidden_text\">                           -3-<\/span><\/p>\n<p>        the queue on the basis of caste and the notification issued<\/p>\n<p>        by the State of Uttar Pradesh.\n<\/p>\n<p>                This writ application is disposed of with the<\/p>\n<p>        observation aforesaid.\n<\/p>\n<\/p>\n<pre>AMIN\/                   (Ajay Kumar Tripathi, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Surya Nath Prasad Nishad vs The State Of Bihar &amp;Amp; Ors on 19 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.7767 of 2010 1.
