(3) 867\n 1989 SCC  (1) 229\t  JT 1988 (4)\t728\n 1988 SCALE  (2)1326\n\n\nACT:\n    Administrative  Law: Black listing--Right to be  heard--\nMaking representation against the order--Necessity for.\n\n\n\nHEADNOTE:\n     The  appellant  has bid in an auction of  Beni  Country\nLiquor Shop in the District of Samastipur and was given\t the\nshop  being the highest bidder but he failed to deposit\t the\nbid money in time.\n     The Collector, Samastipur by an order cancelled the bid\nand black listed the appellant. He then moved the High Court\nagainst\t the order of the Collector. The High  Court  upheld\nthe order of the Collector.\n     The appellant appealed to this Court by special leave.\n     Disposing of the appeal, the Court,\n     HELD: 1. It is an implied principle of the rule of\t law\nthat  any order having civil consequences should  be  passed\nonly  after  following the principles  of  natural  justice.\nBlack-listing any person in respect of business ventures has\ncivil  consequences  for the future business of\t the  person\nconcerned in any event. [868H; 869A]\n     2.\t Even  if  the rules do not express  so,  it  is  an\nelementary   principle\tof  natural  justice  that   parties\naffected  by any order should have right of being heard\t and\nmaking representations against the order. [869B]\n     In\t the  instant  case,  that  portion  of\t the   order\ndirecting that the appellant be placed in the black-list  in\nrespect\t of  future  contracts under the  Collector  is\t set\naside.\tSo  far\t as  the cancellation  of  the\tbid  of\t the\nappellant is concerned, that is not affected. Special leave granted.<br \/>\n     The  order dated 25th March, 1988 of the  Collector  is<br \/>\nunder challenge in this appeal. The same reads as follows:\n<\/p>\n<p>     &#8220;Shri Raghu Nath Thakur S\/o Late Gorakh Thakur, Village<br \/>\nRepura,\t P.S.  Puksha,\tDistrict  Samastipur  had  bid\t for<br \/>\nRs.11,900 (Rupees eleven thousands only) per month Dak in an<br \/>\nauction\t of Beni Country liquor shop held on 27.3.88 and  he<br \/>\nas  given the shop of Beni Country liquor but after  signing<br \/>\nin Bandobasti Register he did not deposit dak amount.\n<\/p>\n<p>     The name of Shri Raghu Nath Thakur S\/o Late Gorakh Nath<br \/>\nVillage\t Repura, P.S. Pusa, Distt. Samastipur  is  therefore<br \/>\nplaced in the black list for future under the orders  passed<br \/>\nby the Collector, Samastipur.&#8221;\n<\/p>\n<p>     This  order  was passed pursuant to the  order  of\t the<br \/>\nCollector.  The\t letter dated 25th March,  1988,  states  as<br \/>\nfollows:\n<\/p>\n<p>     &#8220;The  Collector  of the district after perusal  of\t the<br \/>\nsaid  office note passed order on 25.3.88 which is  produced<br \/>\nin verbatim below:\n<\/p>\n<p>     Ist bidder chunki defaulter hai atah security prapt kar<br \/>\nlen tatha bhavishya ke liae Black list karen. &#8221;\n<\/p>\n<p>     Indisputably, no notice had been given to the appellant<br \/>\nof  the\t proposal  of black-listing the\t appellant.  It\t was<br \/>\ncontended  on behalf of the State Government that there\t was<br \/>\nno requirement in the rule of giving any prior notice before<br \/>\nblack-listing  any person. In so far as the contention\tthat<br \/>\nthere is no requirement specifically of giving any notice is<br \/>\nconcerned,  the\t respondent is right. But it is\t an  implied<br \/>\nprinciple  of  the rule of law that any order  having  civil<br \/>\nconsequence  should  be\t passed\t only  after  following\t the<br \/>\n\t\t\t\t\t\t   PG NO 869<br \/>\nprinciples  of natural justice. It has to be  realised\tthat<br \/>\nblack-listing any person in respect of business ventures has<br \/>\ncivil  consequence  for the future business  of\t the  person<br \/>\nconcerned in any event. Even if the rules do not express so,<br \/>\nit  is\tan  elementary principle  of  natural  justice\tthat<br \/>\nparties\t affected  by any order should have right  of  being<br \/>\nheard and making representations against the order. In\tthat<br \/>\nview of the matter, the last portion of the order in so\t far<br \/>\nas  it directs black-listing of the appellant in respect  of<br \/>\nfuture\tcontracts,  cannot  be\tsustained  in  law.  In\t the<br \/>\npremises,  that\t portion  of the order\tdirecting  that\t the<br \/>\nappellant  be placed in the black-list in respect of  future<br \/>\ncontracts  under the Collector is set aside. So far  as\t the<br \/>\ncancellation of the bid of the appellant is concerned,\tthat<br \/>\nis  not affected. This order will, however, not prevent\t the<br \/>\nState Government or the appropriate authorities from  taking<br \/>\nany  future  steps  for blacklisting the  appellant  if\t the<br \/>\nGovernment  is so entitled to do so in accordance with\tlaw,<br \/>\ni.e.  giving the appellant due notice and an opportunity  of<br \/>\nmaking\trepresentation.\t After hearing\tthe  appellant,\t the<br \/>\nState  Government  will be at liberty to pass any  order  in<br \/>\naccordance  with  law indicating the reasons  therefor.\t We,<br \/>\nhowever, make it quite clear that we are not expressing\t any<br \/>\nopinion\t on the correctness or otherwise of the\t allegations<br \/>\nmade against the appellant.
