SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 5115 of 2009\n               ------------------------------------\n          Dated this the 10th day of September, 2009\n\n                           O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the accused in<\/p>\n<p>C.R. No.123\/2009 of Excise Range, Sasthamcotta.<\/p>\n<p>       2. The offence alleged against the petitioner is under<\/p>\n<p>Section 55 (i) of the Abkari Act.\n<\/p>\n<p>       3. The prosecution case is that on 23.08.2009, the<\/p>\n<p>petitioner was found in possession and engaged in the sale of<\/p>\n<p>Indian Made Foreign Liquor. A quantity of 1.7 litres of I.M.F.L.<\/p>\n<p>was seized. The petitioner was arrested on the spot and he was<\/p>\n<p>remanded to judicial custody.\n<\/p>\n<p>       4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p>       5. The petitioner shall be released on bail on his<\/p>\n<p>executing bond for Rs. 25,000\/- with two solvent sureties each<\/p>\n<p><span class=\"hidden_text\">B.A. No. 5115 of 2009              2<\/span><\/p>\n<p>for the like amount to the satisfaction of the Judicial<\/p>\n<p>Magistrate of the First Class, Sasthamcotta subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>                 A)  The petitioner shall report before the<br \/>\n                      Investigating Officer between 9 A.M.<br \/>\n                      and 11 A.M. on all Mondays, till the<br \/>\n                      final report is filed or until further<br \/>\n                      orders.\n<\/p><\/blockquote>\n<blockquote><p>                 B) The petitioner shall appear before the<br \/>\n                      Investigating Officer for interrogation<br \/>\n                      as and when required.\n<\/p><\/blockquote>\n<blockquote><p>                 C) The petitioner shall not try to influence<br \/>\n                      the prosecution witnesses or tamper<br \/>\n                      with the evidence.\n<\/p><\/blockquote>\n<blockquote><p>                 D)    The petitioner shall not commit any<br \/>\n                      offence or indulge in any prejudicial<br \/>\n                      activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>                 E)     In case of breach of any of the<br \/>\n                      conditions mentioned above, the bail<br \/>\n                      shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>         The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                       K.T.
