{"id":10125,"date":"2011-09-21T00:00:00","date_gmt":"2011-09-20T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/prabhudayal-vs-rambabu-agrawal-on-21-september-2011"},"modified":"2017-03-25T06:10:07","modified_gmt":"2017-03-25T00:40:07","slug":"prabhudayal-vs-rambabu-agrawal-on-21-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/prabhudayal-vs-rambabu-agrawal-on-21-september-2011","title":{"rendered":"Prabhudayal vs Rambabu Agrawal on 21 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Prabhudayal vs Rambabu Agrawal on 21 September, 2011<\/div>\n<pre>                     F.A.No.505\/2009\n                     F.A.No.519\/2009\n\n\n\n\n21.9.2011\n       Shri Sanjay Dwivedi, counsel for plaintiff\/appellant.\n       Shri Avinash Zargar, counsel for defendants\/respondents.<\/pre>\n<p>       I.A.No.8263\/2009 of F.A.No.505\/2009 &amp; I.A.No.8459\/<br \/>\n 2009 of F.A.No.519\/2009.\n<\/p>\n<p>       These appeals are filed against the judgment and decree<br \/>\n dated 7.5.2009 passed by IInd Additional District Judge to the Court<br \/>\n of Ist Additional District Judge, Bhopal in Civil Suit No.335-A\/2007.<br \/>\n The plaintiff and defendants both have challenged the same<br \/>\n judgment and decree in these appeals.\n<\/p>\n<p>       Shri Avinash Zargar, counsel appearing for defendants<br \/>\n submitted that on 1.9.2009 an order was passed by which the<br \/>\n defendants were directed to deposit entire cost amount incurred in<br \/>\n the Court below within a period of thirty days and on such condition<br \/>\n execution of judgment and decree was stayed. It is submitted that<br \/>\n a contradictory order was passed in F.A.No.505\/2009, so the<br \/>\n aforesaid cost could not be deposited.          It is submitted that the<br \/>\n orders may be clarified, so that the defendants may comply with the<br \/>\n order dated 1.9.2009 in F.A.No.519\/2009.\n<\/p>\n<p>       The plaintiff\/appellant opposed the aforesaid contention and<br \/>\n submitted that infact there is no conflict between the orders and<br \/>\n both the orders are operating in separate fields and the<br \/>\n defendant\/appellant of F.A.No.519\/2009 ought to have complied<br \/>\n with the order dated 1.9.2009 in letter and spirit.\n<\/p>\n<p>      To appreciate the aforesaid contention of the parties, it would<br \/>\nbe appropriate if order dated 3.8.2009 in F.A.No.505\/2009 and order<br \/>\ndated 1.9.2009 in F.A.No.519\/2009 are referred, which reads thus :-\n<\/p>\n<blockquote><p>             &#8220;3.8.2009<\/p>\n<p>                     Shri Sanjay Dwivedi, for the appellant.<br \/>\n                     Appeal is admitted for hearing.<br \/>\n                     Issue notice of the appeal as well as of<br \/>\n             I.A.No.8263\/09 to the respondents on payment<br \/>\n                       F.A.No.505\/2009<br \/>\n                      F.A.No.519\/2009<\/p>\n<p>              of process fee within a week.\n<\/p><\/blockquote>\n<blockquote><p>                       Call for the records.\n<\/p><\/blockquote>\n<blockquote><p>                       In the meanwhile, till the next date of<br \/>\n              listing, recovery of interest @ 12% per annum<br \/>\n              and the direction to the appellant to deposit a<br \/>\n              sum of Rs.6,23,000\/- shall remain stayed.\n<\/p><\/blockquote>\n<blockquote><p>                       List for hearing alongwith the records.<br \/>\n                       Certified copy as per rules.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>              &#8220;1.9.2009<br \/>\n                       Shri Alok Aradhe, learned Sr. Adv., with<br \/>\n              Shri Abhishek Gulatee, counsel for appellant.\n<\/p><\/blockquote>\n<blockquote><p>                       Admit.\n<\/p><\/blockquote>\n<blockquote><p>                       Issue notice to the respondents. Steps within a period of one week<br \/>\n              by Regd. A\/D mode.\n<\/p><\/blockquote>\n<blockquote><p>                       Till further orders, execution of judgment<br \/>\n              and decree passed by the Court below shall<br \/>\n              remain stayed on following terms :-\n<\/p><\/blockquote>\n<blockquote><p>              1.       Appellant to furnish security as required<br \/>\n              under Order 41 Rule 5 C.P.C., to the satisfaction<br \/>\n              of trial Court I.A.No.8263\/2009 that the<br \/>\n              appellant shall abide the judgment, decree or<br \/>\n              order, as may be passed in this appeal.\n<\/p><\/blockquote>\n<blockquote><p>              2.       Appellant to deposit entire costs incurred<br \/>\n              in the Courts below within a period of thirty days<br \/>\n              from today.\n<\/p><\/blockquote>\n<blockquote><p>                       Record of the Court below be sent for.<br \/>\n                       C.C., as per rules.&#8221;<\/p><\/blockquote>\n<p>       From the perusal of aforesaid orders, it is apparent that in<br \/>\nF.A.No.505\/2009 on the appeal of plaintiff, direction of the trial Court<br \/>\nin respect of deposit of remaining amount alongwith 12% interest<br \/>\nwere stayed. So far as F.A.No.519\/2009 on a appeal by defendants<br \/>\nthe execution of judgment and decree was stayed on furnishing<br \/>\nsecurity, as is required under Order 41 Rule 5 C.P.C., and it was<br \/>\ndirected to deposit entire cost incurred in the Court within a period of<br \/>\nthirty days. From the perusal of aforesaid orders, it is apparent that<br \/>\nboth the orders are operating in separate fields and are not<br \/>\nconflicting to each other.\n<\/p>\n<p>       In these circumstances, we clarify the order and direct that the<br \/>\n                          F.A.No.505\/2009<br \/>\n                         F.A.No.519\/2009<\/p>\n<p>    defendants against whom decree has been passed shall comply with<br \/>\n    the order dated 1.9.2009 within a period of two weeks from today.<br \/>\n    So far as F.A.No.505\/2009 is concerned, the order dated 3.8.2009 by<br \/>\n    which the direction of the trial Court directing deposit of remaining<br \/>\n    sale price with 12% interest shall remain stayed.
