The<br \/>\namendments may be carried out, forthwith.\n<\/p>\n<p>\tThis<br \/>\napplication has been filed with a prayer to bring on record of the<br \/>\npetition the applicants, who are the heirs and legal representatives<br \/>\nof the original petitioner of Special Civil Application No.6069\/2004<br \/>\nSmt.Feithben wd\/o. Maneklal Jivabhai Christian, as petitioners, after<br \/>\nexpiry of the original petitioner on 3.9.2005 and further to set<br \/>\naside the abatement by condoning the delay.\n<\/p>\n<p>\tHeard<br \/>\nMr.Jayraj Chauhan, learned advocate for Mr.U.M.Shastri, learned<br \/>\ncounsel for the applicants and perused the averments made in the<br \/>\napplication.\n<\/p>\n<p>\tAs<br \/>\nper a copy of the Death Certificate of Smt.Feithben  wd\/o. Maneklal<br \/>\nJivabhai Christian, original petitioner of Special Civil Application<br \/>\nNo.6069\/2004, the said petitioner expired on 3.9.2005. The<br \/>\napplication is dated 31.8.2006. It is averred in the application that<br \/>\napplicants Nos.1\/1 to 1\/6, whose names are reflected in the cause<br \/>\ntitle of the application, are the only heirs and legal<br \/>\nrepresentatives of the original petitioner and may be joined in the<br \/>\npetition as petitioners.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned counsel for the applicants and in view of the<br \/>\naverments made in the application, the prayers made therein deserve<br \/>\nto be granted.\n<\/p>\n<p>\tAccordingly,<br \/>\nthe application is allowed. The delay in filing the application is<br \/>\ncondoned and abatement is set aside.
