SHAH AGP for Petitioner(s) : 1, \nMR PRABHAKAR UPADYAY for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the judgment and award passed by the Labour Court, Junagadh in<br \/>\nReference (LCJ) No.99\/1995 dated 04.02.2004, whereby, the said<br \/>\nreference was partly allowed and the petitioner has been directed to<br \/>\nreinstate the respondent on his original post with continuity of<br \/>\nservice and 40% back wages.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the respondent was working as a Peon with the<br \/>\npetitioner-State since 03.05.1991. However, on 01.09.1994, his<br \/>\nservices came to be terminated. Against the said action, the<br \/>\nrespondent raised a dispute, which, ultimately, culminated into a<br \/>\nreference before the Labour Court, Junagadh. The Labour Court, after<br \/>\nconsidering the evidence on record, partly allowed the said<br \/>\nReference, by passing the impugned award. Hence, this petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. While appreciating the evidence on record, the Labour<br \/>\nCourt found that the respondent had worked for more than 240 days in<br \/>\nthe preceding year. However, while terminating his services, the<br \/>\npetitioner had not followed the mandatory provisions of Section 25F<br \/>\nof the Industrial Disputes Act. It is also established from the<br \/>\nrecord that the respondent was discharging his duties regularly and<br \/>\nthat he was not served with any show-cause notice or memo during his<br \/>\nservice tenure with the petitioner. After considering the entire<br \/>\nevidence on record, the Labour Court came to the conclusion that the<br \/>\naction of the petitioner, terminating the services of the respondent,<br \/>\nwas violative of the provisions of Section 25F of the I.D. Act and<br \/>\naccordingly, directed the petitioner to reinstate the respondent with<br \/>\ncontinuity of service.\n<\/p>\n<p>4.\tHowever,<br \/>\nso far as the question regarding back wages is concerned, the Court<br \/>\nbelow has not given any cogent reasons while awarding the same. In<br \/>\nthe case of <a href=\"\/doc\/800069\/\">Ram Ashrey Singh v. Ram Bux Singh,<\/a> (2003)<br \/>\nII L.L.J. Pg.176, the Apex Court has held that a workman has<br \/>\nno automatic entitlement to back wages since it is discretionary and<br \/>\nhas to be dealt with in accordance with the facts and circumstances<br \/>\nof each case.\n<\/p>\n<p>\tSimilar<br \/>\nprinciple has been laid down by the Apex Court in the case of General<br \/>\nManager, Haryana Roadways v. Rudhan Singh,<br \/>\nJ.T. 2005 (6) S.C.,pg. 137, [2005 \/(5) S.C.C.,pg.591],<br \/>\nwherein, it has been held that an order for payment of back wages<br \/>\nshould not be passed in a mechanical manner but, a host of factors<br \/>\nare to be taken into consideration before passing any such order.\n<\/p>\n<p>\tIt<br \/>\nwould also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1910753\/\">A.P. State Road Transport &amp; Ors., v. Abdul<br \/>\nKareem,<\/a> (2005) 6 S.C.C. pg.36, wherein it has been held that<br \/>\na workman is not entitled to any consequential relief on<br \/>\nreinstatement as a matter of course unless specifically directed by<br \/>\nforum granting reinstatement.\n<\/p>\n<p>5.\tLooking<br \/>\nto the facts of the case and the principle laid down by the Apex<br \/>\nCourt in the above decisions, I am of the opinion that the<br \/>\nrespondent-workman cannot be said to be entitled for any back wages.<br \/>\nHence, the impugned award granting 40% back wages deserves to be<br \/>\nquashed and set aside.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the petition is partly allowed. The impugned<br \/>\naward passed by the Labour Court is modified to the extent that the<br \/>\ndirection regarding reinstatement on the original post with<br \/>\ncontinuity in service is confirmed and the direction regarding grant<br \/>\nof 40% back wages is quashed and set aside. With the above<br \/>\nmodification, the petition stands disposed of. Rule is made absolute<br \/>\nto the above extent with no order as to costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
