The<\/p>\n<p>essential issue pertains to the question as to whether the<\/p>\n<p>appellant\/employer is entitled to withhold amounts payable<\/p>\n<p>under the Payment of Gratuity Act, 1972. The learned single<\/p>\n<p>Judge held that the issue is wholly covered against the<\/p>\n<p>appellant by atleast three decisions of this court including the<\/p>\n<p>Bench decision in <a href=\"\/doc\/1191597\/\">Mathew v. Plantation Corporation of<\/p>\n<p>Kerala Ltd.<\/a> (2000 (3) KLT 107). Though learned counsel for<\/p>\n<p>the appellant-management made a vehement attempt to<\/p>\n<p>persuade this court to take a different view pursuant to the<\/p>\n<p>decision taken by the High Court of Delhi in State Farm<\/p>\n<p>Corporation of India Ltd. v. Regional Commissioner &amp;<\/p>\n<p>Another, (2007 (1) LLJ 763), we find it difficult to be<\/p>\n<p>W.A.No.1021 of 2008<\/p>\n<p><span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>persuaded.     The High Court of Kerala has taken a consistent<\/p>\n<p>view.   We also find that the issue is otherwise broadly covered<\/p>\n<p>by the decision of the Supreme Court in <a href=\"\/doc\/1416283\/\">D.S.Nakara v. Union of<\/p>\n<p>India (AIR<\/a> 1983 SC 130). Therefore, the appeal fails and it is<\/p>\n<p>accordingly dismissed.\n<\/p>\n<p>     2. Learned counsel for the appellant\/petitioner submits that<\/p>\n<p>the dismissal of the appeal may not stand in the way of the<\/p>\n<p>appellant taking recourse to their remedy before appropriate<\/p>\n<p>forum    and    in  which    case    the   time   taken   by   the<\/p>\n<p>appellant\/petitioner before this court in bona fide prosecuting the<\/p>\n<p>writ petition and the writ appeal may be excluded. If any such<\/p>\n<p>course of action is open to the appellant\/writ petitioner before<\/p>\n<p>any forum under law, it is open to the appellant\/petitioner to<\/p>\n<p>approach that forum and the permission of this court is not<\/p>\n<p>necessary and needless to say that the judgments of this court<\/p>\n<p>will not stand in the way of the appellant\/petitioner taking<\/p>\n<p>recourse to such action.
