Left fronio parieto occipital depressed fracture\n\n \n\n\n\nThe claimant was treated in D.G..Hospital from\n11.08.2005 to 29.08.2005 and 25.09.2005 to \n\nThe claimant had undergone operation forvw_oiirid..p\n\ndebridenient, elevation of depressed   and\n\nduroplasty. The C.T.scan report 'llefi\n\nfronto parietal with acute: _subd'u1ral. haernatonia \n\nhaemorrhagic eontusions. Thotighlllelaimami   for a\nperiod of eight m0nth.s':;~.,;\u00bb;is  n\u00a2{\"in:p}ove. The\nclaimant suffers from speech ,ln_r_ight hemiperesis\nand weak meirioieglpiiaoxifer.   0  0\n\nAt the   was aged about 19\nyears.:'tVl?le0V  a l'l'prainVee--cLin1\u00bbOperator in lVI\/ s.\n  a salary of Rs.2.400\/-- per\n\nmonth, besidesphe wasdoing part time job in a provision\n\n   r;lailyuWage._oi' Rs.50\/~ per day. PW4 on subsequent\n\n' .eX'aminatiom oielaimarit, having regard to his condition has\n\n physical disability of whole body at\n\n\n\n4. The Tribunal has awarded conipensaiion of\nRs.7,97,-400\/-- under following heads:-\nI. Pain &amp; suffering : Rs.   \n\n11. Sri\"   Coiinsel for Insurance\nCompany__woiil:iVsgilbinitfliai Tribunal did not have sufficient\nmaterial to determine  of claimant at Rs.3,900\/~ per\n\nniorgtn.   Ali Khan, who has assessed\n\n pefmanlentll physical disability is not. a neuro surgeon. The\n\nA   ofdisability is on the higher side. Compensation\n\nawardeci*bj(}Ti'ibunaI under the head \"loss of earI1ings during\n\n 'laid up \"period\" cannot be sustained since \"loss of earning\n\n5 '2 ;\nW 9 (:,:%\\\/L, g@,.E\u00ab__ I\n\nLn\n\n\n\n.. The \n\n100% permanent physical disabi1ii.3fj'*f\u00a3'he claizrianvi; \n\nconstant attendant. The claimanteannot do any work on his\nown; he cannot attend\"~..\u00a7o Iiis_ b'a.sie\"needs. The marital\nprospects of claimant is eon1p1etely=._vbieakened. The Tribunal having regard\n\n 't.o\u00b0r---.atu_re'r  injuries, consequent pain and suffering, has\n\nawarded'tzornpensation of Rs.70.000\/~ under the head \"pain\n\nar1dl::.ul\"fering\". The Tribunal   Qeonipensaiiion of\nRs.i,00,000\/~ pander :\"the~  amenities 81\nenjoyment _of it as excessive,\nhavingivpregairdiiyt\u00e9iipthe  claimant has to depend on\nothers diuitiprig  of life and even to attend\n\nto hisbasic rieeds'diirir.g the rest of his iife, which is likely to\n\nVispread ubverhifor several decades. The Triburial having noticed\n\nI  physical and mental faculty has been\n\nirnpaired'  this marital prospects is completely bleakened,\n\ndhas Zawarded eornpensation under the head \"loss of\n\n'' ._mai\"it--a1 prospects\".
