Perused the application as well as the relevant<br \/>\n\tpapers annexed with the application, so also annexed with the<br \/>\n\tappeal, and heard Mr.MS Shah, ld.advocate for Mr.YV Vaghela,<br \/>\n\tld.advocate for the applicants and Mr.SM Shukla, ld.advocate for<br \/>\n\trespondents No.2 and 3. None appeared for respondent No.1.\n<\/p>\n<p>Having considered the submissions<br \/>\n\tadvanced on behalf of both the sides, so also considering the<br \/>\n\tcontents of the application as well as the papers annexed with the<br \/>\n\tapplication and with the appeal, it transpires that respondent No.1<br \/>\n\therein filed the aforementioned suit against respondents No.2 and 3<br \/>\n\tseeking permanent injunction against respondents No.2 and 3 herein<br \/>\n\tfor the protection of his alleged possession of the disputed<br \/>\n\tproperty. The copy of Rojkam annexed with the appeal papers at<br \/>\n\tAnnexure G reveals that the suit was filed on 08.10.2010, and after<br \/>\n\tsome time, the suit was adjourned to hear the notice of motion on<br \/>\n\t1.11.2010, but it seems that the suit appears to have been<br \/>\n\tcompromised on 22.10.2010 by preponing the date. By virtue of the<br \/>\n\tcompromise, the respondent Nos.2 and 3 herein undertook that they<br \/>\n\twill not snatch away the possession of respondent No.1 of the<br \/>\n\tdisputed property and they would not cause any obstruction in the<br \/>\n\tsame. The aforesaid suit came to be disposed of on the basis of the<br \/>\n\tsaid compromise. The case put up by the applicants herein is that<br \/>\n\tthey entered into one agreement with the original owners of the<br \/>\n\tdisputed property, namely, respondents No.2 and 3 herein on<br \/>\n\t16.08.2009 for purchase of the disputed property, and according to<br \/>\n\tthe applicants, some payment was made at the time of execution of<br \/>\n\tthe agreement, and it is submitted that the remaining payment was<br \/>\n\tmade till the end of the year 2010. It is further submitted on<br \/>\n\tbehalf of the applicants that since the date of execution of the<br \/>\n\tagreement dated 16.8.2009, the actual and physical possession of the<br \/>\n\tdisputed property was handed over by the original owners of the<br \/>\n\tproperty to the applicants. Mr.Shah, ld.advocate for the applicants<br \/>\n\tdrew my attention to sub-rule 2 of Rule 1(A) of Order 43 of the Code<br \/>\n\tof Civil Procedure, so also the case of State of Punjab Vs.Amar<br \/>\n\tSingh reported in AIR<br \/>\n\t1974 SC 994.\n<\/p>\n<p>\tOn the other hand,<br \/>\n\tMr.Shukla, ld.advocate for the respondents No.2 and 3 opposed this<br \/>\n\tapplication and submitted that no registered sale-deed was ever<br \/>\n\texecuted in connection with the alleged sale of the disputed<br \/>\n\tproperty and no full and final payment was ever made. It is,<br \/>\n\ttherefore, submitted that the application itself is not maintainable<br \/>\n\tand deserves to be dismissed.\n<\/p>\n<p>Considering<br \/>\n\tthe submissions advanced on behalf of both the sides, so also<br \/>\n\tconsidering the relevant papers annexed with the application as well<br \/>\n\tas the appeal, and considering the above-referred provisions<br \/>\n\tcontained in the CPC and the ratio laid down by Hon&#8217;ble the Apex<br \/>\n\tCourt in the above-referred decision, this Court is of the<br \/>\n\tprima-facie opinion that the applicants can be said to have been<br \/>\n\tadversely affected by the compromise arrived at in the suit and<br \/>\n\tatleast they can be said to be aggrieved party. Admittedly, in the<br \/>\n\taforesaid suit, the respondent No.1 (plaintiff in said suit) has not<br \/>\n\tjoined the applicants herein, as one of the parties to said suit.<br \/>\n\tWhen such is the situation,<br \/>\n\tthe application deserves to be allowed.\n<\/p>\n<p>\tIt is hereby<br \/>\n\tclarified that whatever observation made by this Court in this order<br \/>\n\tis confined only to the fact as to whether the leave to file the<br \/>\n\tappeal should be granted to the applicants or not, and the rights of<br \/>\n\tthe respondents to contest the matter, if occasion so arises, shall<br \/>\n\tnot be construed to have been adversely affected. With this<br \/>\n\tclarification, the application is allowed. The applicants are<br \/>\n\tpermitted to prefer the appeal.
