Misc.Civil Application No. 193 of 2003\n           MR PRABHAV A MEHTA for Petitioner No. 1-1\/3\n           .......... for Respondent No. 1-4\n\n\n      --------------------------------------------------------------\n\n\n                 CORAM : MR.JUSTICE KUNDAN SINGH\n\n\n                 Date of Order: 02\/05\/2003\n\n\n ORAL ORDER<\/pre>\n<p>Heard the learned counsel for the petitioner.\n<\/p>\n<p>      2.This is an application for recalling an order<br \/>\n      dated 23rd March 2000 passed in Second Appeal No. 117 of<br \/>\n      1992 and for restoration of the Second Appeal No. 117 of<br \/>\n      1992 on its original file.\n<\/p>\n<p>      3.The contention of the learned counsel for the<br \/>\n      petitioner is that power of attorney holder was not given<br \/>\n      power to withdraw the appeal hence the order dated 23rd<br \/>\n      March 2000 is required to be recalled. He produced a<br \/>\n      copy of the power of attorney, wherein, clause 7 states<br \/>\n      as under:\n<\/p>\n<p>       &#8220;The holder of the power of attorney is also<br \/>\n              appointed and authorised on our behalf to deal<br \/>\n              with any dispute in any matter, if arises, with<br \/>\n              regard to development of the properties described<br \/>\n              in the appendix and will be further authorised to<br \/>\n              arrive at any compromise or to hold negotiations<br \/>\n              in regard to such dispute or to file          any<br \/>\n              proceedings of nature of civil, criminal, revenue<br \/>\n          related    proceedings before the Collector or<br \/>\n         before any other Court of laws, and further<br \/>\n         authorised    to appear and file reply before<br \/>\n         aforesaid authorities or Court of law as well as<br \/>\n         to   arrive    at compromise or to accept any<br \/>\n         settlement, so also, to accept       the   money,<br \/>\n         issuance of the receipts and, would be further<br \/>\n         authorised to undertake all other proceedings<br \/>\n         relevant in the matter.&#8221;\n<\/p>\n<p>4.The contention of the learned counsel for the<br \/>\npetitioner is that the power of attorney holder was not<br \/>\nauthorised to withdraw the proceedings of the Second<br \/>\nAppeal which was pending in this Court.    The power of<br \/>\nattorney has been given to prosecute and not to withdraw,<br \/>\nand the Delhi High Court has taken the view that the<br \/>\nprosecution does not     include   the   compromise   for<br \/>\nwithdrawal of the proceedings and he relied on the<br \/>\ndecision of the Delhi High Court reported in the case of<br \/>\n<a href=\"\/doc\/678601\/\">DR. MANMOHAN SINGH DALIWAL V. GURBAX SINGH ARORA AND<br \/>\nOTHERS,<\/a> 2002 AIH C 275 and it is held therein as under:\n<\/p>\n<p> &#8220;The   conspectus of following facts manifestly<br \/>\n         show that the fraud played upon the Court is writ<br \/>\n         large on the face of the impugned order:\n<\/p>\n<p> (i)The suit came up for hearing on 26.7.1999<br \/>\n        wherein interim injunction was passed and Local<br \/>\n        Commissioner for visiting the suit property was<br \/>\n        appointed.\n<\/p>\n<p> (ii)On 8.10.1999 the defendants appeared and<br \/>\n        sought time to file the written statement. On<br \/>\n        13.3.2000 the defendants again sought the time.<br \/>\n        Adjournment   was granted subject to cost of<br \/>\n        Rs.5,000.00. Case was adjourned for 11.7.2001.\n<\/p>\n<p> (iii)Though the application under Order 23,<br \/>\n        Rule 3, CPC was signed on 10th April but was<br \/>\n        filed on 18th April when the case was taken up on<br \/>\n        mentioning though the actual date fixed was 11th<br \/>\n        July, 2000.      Feverish   hurry   has remained<br \/>\n        unexplained.\n<\/p>\n<p> (iv)Suddenly a new counsel was engaged in<br \/>\n        order to keep the earlier counsel in dark about<br \/>\n        the compromise and this bares the designs and the<br \/>\n        intention of the attorney and the defendants 1 &amp;\n<\/p>\n<p>        2.<\/p>\n<p> (v)The signatures of the attorney appear   at<br \/>\n         the   place meant for the signatures of the<br \/>\n        plaintiff and at first glance it gives the<br \/>\n        impression   as   if plaintiff has signed the<br \/>\n        application and that is why the Court observed<br \/>\n        that the application has been signed by the<br \/>\n        plaintiff whereas it was actually signed by the<br \/>\n        attorney.\n<\/p>\n<p> (vi)Merely   because   the   application was<br \/>\n        supported by an affidavit of the attorney does<br \/>\n        not mean that attorney was conferred the power to<br \/>\n        compromise the matter nor does this affidavit<br \/>\n        disclose that the application for compromise has<br \/>\n        been duly signed by the plaintiff\/applicant.\n<\/p>\n<p> (vii)There was no specific power conferred<br \/>\n        upon the attorney to enter into the compromise.<br \/>\n        In such cases where the immovable property is to<br \/>\n        be sold, vesting of such power in the attorney<br \/>\n        becomes more essential.      In absence of such a<br \/>\n        power,   the   attorney   is    precluded    from<br \/>\n        compromising the suit.     Thus the application<br \/>\n        under order 23, Rule 3, CPC as well as the<br \/>\n        withdrawal of the suit was without any authority<br \/>\n        from the plaintiff.&#8221;\n<\/p>\n<p>5.I do not find any substance in the contention of<br \/>\nthe learned counsel for the applicant that the person<br \/>\nholding power of attorney was not given the power to<br \/>\nwithdraw the suit as no power or consent was given under<br \/>\nthe power of attorney to the holder of power of attorney<br \/>\nfor the withdrawal of the proceedings.      As it would<br \/>\nappear from clause-8 of the power of attorney that all<br \/>\npowers including settlement, compromise and to initiate<br \/>\nproceedings and acceptance of money on behalf of the<br \/>\nappellants in the proceedings have already been given to<br \/>\nthe person holding the power of attorney. To prosecute<br \/>\nincludes word of withdrawal. If there is any dispute<br \/>\nbetween the power of attorney and the persons authorising<br \/>\nto exercise the powers that matter can be decided by<br \/>\nappropriate Court of law not by this Court as that matter<br \/>\ncan be decided only by giving an opportunity of leading<br \/>\nevidence to the parties concerned.       That cannot be<br \/>\ndecided by this Court.   As in the present case, the<br \/>\nstatement was made by the learned counsel on behalf of<br \/>\nthe appellant that he does not want to press the appeal<br \/>\non the instructions of the appellant. Hence, he sought<br \/>\npermission to withdraw the same and the permission was<br \/>\ngranted and the appeal was disposed of as withdrawn.
