PUBLIC PROSECUTOR for\nOpponent. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/09\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.0\t\tBy<br \/>\nway of this appeal, the appellant has challenged the judgment and<br \/>\norder of the learned Special Judge, Bhavnagar passed in Special<br \/>\nCriminal Case(Atrocity) No.3 of 1993 dated 25.01.1995.\n<\/p>\n<p>2.0\t\tThe<br \/>\nappellant, herein, is original accused who was charged with and<br \/>\nconvicted for the offence punishable under Section 3(1)(10) of the<br \/>\nAtrocity Act and was sentenced to undergo rigorous imprisonment for<br \/>\nsix months and to pay fine of Rs.1,000\/- and in case of default to<br \/>\nundergo rigorous imprisonment for further two months.  He was also<br \/>\ncharged with and convicted for the offence punishable under Section<br \/>\n323 of the I.P.C. and was sentenced to undergo simple imprisonment<br \/>\nfor one month and to pay fine of Rs.100\/- and in case of default to<br \/>\nundergo further simple imprisonment for a period of five days.\n<\/p>\n<p>3.0\t\tAs<br \/>\nper the charge Exhibit-2 framed against the appellant, the<br \/>\nprosecution case was that on 08.12.1990, at about 8:00 p.m. while the<br \/>\ncomplainant, who belongs to schedule caste community, was sitting<br \/>\nnear the quarters of Gram Sevak, at that time, original accused-the<br \/>\nappellant, herein, picked up quarrel with him (the complainant). The<br \/>\nappellant used abusive words about the caste of the complainant and<br \/>\nalso delivered kick blows to him and thereby committed the offences<br \/>\nas mentioned above. The complainant, hence, lodged complaint against<br \/>\nthe appellant with Botad Police Station.  On completion of the<br \/>\ninvestigation, the case was committed before the trial Court.  The<br \/>\nappellant did not plead guilty and claimed to be tried.  Hence, at<br \/>\nthe end of the trial, the trial Court convicted and sentenced the<br \/>\nappellant as mentioned in Paragraph-2 of the judgment.\n<\/p>\n<p>4.0\t\tThe<br \/>\nprosecution in support of its case has examined four witnesses i.e.<br \/>\n(1) Bhagvanbhai Rupabhai Harijan-P.W.-1, (2) Rameshbhai Jivabhai<br \/>\nHarijan-P.W.-2, (3) Devubha Kalubha-P.W.-3, (4) Kishorsinh<br \/>\nNarsinh-P.W.4.\n<\/p>\n<p>5.0\t\tBhagvanbhai<br \/>\nRupabhai Harijan-the complainant- P.W.-1 was examined at Exhibit-8.<br \/>\nHe deposed that he resides at Pati village and since accused is also<br \/>\nresident of Pati, he knows him very well.  He has further deposed<br \/>\nthat the incident in question took place before three years. On that<br \/>\nday he was sitting near the quarter of Gram Sevak since<br \/>\n&#8216;fuleku'(Procession) was to pass-by in the village. He has deposed<br \/>\nthat since there was darkness, he is not aware as to who else were<br \/>\nsitting there. At that time, the appellant herein picked up quarrel<br \/>\nwith him and used abusive word about his caste.  The appellant also<br \/>\ndelivered kick blows to him.  Hence, he consulted the advocate and<br \/>\nlodged the complaint. He deposed that he had filed the complaint on<br \/>\nthe next day. He has further deposed that there is no reason for<br \/>\nfiling the complaint on the next day.\n<\/p>\n<p>5.1\t\tP.W.-1,<br \/>\nin his cross-examination, stated that at the time of commission of<br \/>\nalleged offence, there was darkness and many persons had gathered<br \/>\nthere. He stated that it is not true that he cannot identify the<br \/>\nperson amongst the crowd who had used abusive words about his caste.<br \/>\nHe further stated that he used to work with the appellant and his<br \/>\nbrother. He stated that while he was working with the appellant, the<br \/>\nappellant did not say anything. He further stated that after the<br \/>\nappellant delivered him kick blows, he had not gone to see doctor.\n<\/p>\n<p>6.0\t\tRameshbhai<br \/>\nJivabhai-P.W.-2 was examined at Exhibit-10.  He deposed that he knows<br \/>\nthe complainant as well as the appellant.  On the date of alleged<br \/>\nincident, he was sitting near the temple and he along with other<br \/>\npeople went near the complainant and the appellant after the scuffle<br \/>\ntook place between them.  The appellant used abusive words about the<br \/>\ncaste of the complainant and told him that why are you people not<br \/>\nrepaying the money, after borrowing the same?  He further deposed<br \/>\nthat the appellant delivered kick blows to the complainant.\n<\/p>\n<p>6.1\t\tP.W.-2,<br \/>\nin his cross-examination, stated that it is not true that he had not<br \/>\nseen the appellant delivering kick blows to the complainant.  He<br \/>\nfurther stated that it is not true that there was darkness. The light<br \/>\nof mercury was there.  This witness stated that it is not true that<br \/>\nhe was not present at the place of incident and that he had not seen<br \/>\nanything. This witness denied that it is not true that no such<br \/>\nincident had taken place and since he and the complainant belong to<br \/>\nthe same caste, he was deposing wrongly.\n<\/p>\n<p>7.0\t\tProsecution<br \/>\nalso examined other witnesses, but, it would not be relevant to take<br \/>\nnote of their depositions in detail.\n<\/p>\n<p>8.0\t\tIn<br \/>\nthe light of the above evidence, now, it has to be examined as to<br \/>\nwhether trial Court has committed an error in convicting the<br \/>\nappellant or not.\n<\/p>\n<p>9.0\t\tThe case<br \/>\nput forward by the prosecution before the trial Court was that on the<br \/>\ndate of alleged incident the appellant herein picked up quarrel with<br \/>\nP.W.-1 and also delivered kick-blows to him, and thus, it was alleged<br \/>\nthat the appellant committed the offence punishable under Section 323<br \/>\nof the I.P.C.\n<\/p>\n<p>9.1\t\tSo far<br \/>\nas the conviction of the appellant under Section 323 of the I.P.C. is<br \/>\nconcerned, Mr. Lakhani, learned Advocate for the appellant has<br \/>\nsubmitted that the same is compoundable. In support of his say, Mr.<br \/>\nLakhani has produced a compromise &#8216;Pursis&#8217; signed by the original<br \/>\ncomplainant as well as the appellant in the  presence of witnesses<br \/>\nand they are all present in the Court.  The original<br \/>\ncomplainant-Bhagvanbhai Rupabhai Harijan has submitted that with a<br \/>\nview to maintain the harmony between both the communities, the<br \/>\ncompromise has been arrived at between both the parties.\n<\/p>\n<p>9.2\t\tIn view<br \/>\nof the compromise produced by Mr. Lakhani, the conviction of the<br \/>\nappellant qua Section 323 of the I.P.C. deserves to be quashed and<br \/>\nset aside. The compromise &#8216;Pursis&#8217; is ordered to be taken on record.\n<\/p>\n<p>9.3\t\tSo far<br \/>\nas the conviction of the appellant under Section 3(1)(10) of the<br \/>\nAtrocity Act is concerned the same is non-compoundable, and hence, it<br \/>\nwas argued by Mr. Lakhani that the alleged incident took place on<br \/>\n08.12.1990 whereas the complaint was filed by the complainant on the<br \/>\nnext day that too after consulting an advocate.  Even, P.W.-1-himself<br \/>\nin his cross-examination has admitted that there is no reason for<br \/>\nfiling the complaint on the next day.  P.W.-1 also admitted before<br \/>\nthe Court that when the alleged offence took place there was<br \/>\ndarkness. It has also come on record in the evidence of P.W.-1 that<br \/>\nhe used to work with the appellant and his brother and while he was<br \/>\nworking with them they had not said anything.\n<\/p>\n<p>9.4\t\tSo far<br \/>\nas the evidence of P.W.2 are concerned, he deposed that on the date<br \/>\nof alleged offence the appellant picked up quarrel with P.W.-1 using<br \/>\nabusive words about the caste of P.W.-1, saying ?SWhy you ___are not<br \/>\nreturning money, after borrowing the same???.  P.W.-2, in his<br \/>\ncross-examination, stated that at the time of commission of offence<br \/>\nthere was light of mercury which is in stark contradiction to the<br \/>\nevidence of P.W.-1 who, in his deposition, deposed that there was<br \/>\ndarkness at the time of commission of offence. Apart from that as per<br \/>\nthe say of P.W.-1, on the date of alleged incident, the appellant<br \/>\nasked him as to who was sitting there and on knowing that P.W.-1 was<br \/>\nsitting there he picked up quarrel with P.W.-1, using abusive words<br \/>\nabout the caste of P.W.-1 whereas as per the say of P.W.-2, the<br \/>\nappellant was abusing P.W.-1 saying that why you__ are not returning<br \/>\nthe money, after borrowing the same? Hence, it clearly transpires<br \/>\nthat there are vital contradictions in the evidence of P.W.-1 and<br \/>\nP.W.-2 so far as the manner in which the offence in question took<br \/>\nplace. Apart from that no satisfactory explanation was given by<br \/>\nP.W.-1 before the trial Court, for filing the complaint late.  It has<br \/>\nalso come on record by way of evidence of P.W.-1 himself that<br \/>\nwhenever he went to work with the appellant, no untoward incident<br \/>\ntook place.  As per the say of P.W.-1, at the time of commission of<br \/>\nalleged offence, many persons had gathered there, but, none of the<br \/>\naforesaid persons was examined by P.W.-1 in support of his case.\n<\/p>\n<p>10.0\t\tIn view<br \/>\nof the above discussion, I am of the opinion that the trial Court has<br \/>\ncommitted an error in convicting the appellant.\n<\/p>\n<p>11.0\t\tIn the<br \/>\nresult, the appeal is allowed. The judgment and order of conviction<br \/>\nand sentence passed by the learned Special Judge, Bhavnagar in<br \/>\nSpecial Criminal Case(Atrocity) No.3 of 1993 dated 25.01.1995 is<br \/>\nquashed and set aside.  The appellant is acquitted of the offences<br \/>\npunishable under Section 323 of the I.P.C. and Section 3(1)(10) of<br \/>\nthe Prevention of Atrocity Act.
