Land Acquisition<br \/>\n\tOfficer, learned advocate Mr. VN Rawal appearing for respondent<br \/>\n\tclaimants.\n<\/p>\n<p>On<br \/>\n\t29\/9\/2008, this Court has issued Rule and granted stay on condition<br \/>\n\tto deposit decretal amount before returnable date.\n<\/p>\n<p>I<br \/>\n\thave considered submission made by both learned advocates. After<br \/>\n\tperusing award in question, according to my opinion, respondent<br \/>\n\tclaimants at this stage, entitle 50% amount, to be released in their<br \/>\n\tfavour.\n<\/p>\n<p>Accordingly,<br \/>\n\tit is directed to Reference Court, Baroda to release 50% amount as<br \/>\n\tdeposited by applicant before Reference Court by issuing A\/c payee<br \/>\n\tcheque in the name of respondent claimants and rest of amount is to<br \/>\n\tbe invested in any Nationalized Bank for a period of three years<br \/>\n\twith cumulative interest in the name of respondent claimants. The<br \/>\n\tFDR is to be remained with Reference Court with periodical renewal.<br \/>\n\tThe respondent claimants are not entitled any amount of interest<br \/>\n\tupon said FDR till appeal is finally decided by this Court.\n<\/p>\n<p>In<br \/>\n\tview of above observation and direction, Rule is made absolute in<br \/>\n\teach application.
