Case No. 7 (M) of 2008 whereby the<\/p>\n<p>                  petition filed by the petitioner for recall of the order and<\/p>\n<p>                  award dated 14.8.2007 passed in Case No. 849 (D) of<\/p>\n<p>                  2006 has been rejected.\n<\/p>\n<p>                           The    learned    counsel     for   the    petitioner<\/p>\n<p>                  submitted that the petitioner has also got share in the<\/p>\n<p>                  property, which have been divided between the parties<\/p>\n<p>                  before the Lok Adalat and an award has been passed.<\/p>\n<p>                  The   petitioner    was   not   made   party   in   the   said<\/p>\n<p>                  proceeding before the Lok Adalat. In such view of the<\/p>\n<p>                  matter, the petitioner filed an application before the Lok<\/p>\n<p>                  Adalat to recall the said order and award passed by the<\/p>\n<p>                  permanent Lok Adalat which has been rejected by the<\/p>\n<p>                  impugned order. The learned counsel further submitted<\/p>\n<p>                  that if the impugned order and award of the permanent<\/p>\n<p>                  Lok Adalat is not set aside grave injustice would<\/p>\n<p>                  occasion and the petitioner shall suffer serious loss and<\/p>\n<p>                  irreparable injury.\n<\/p>\n<p>                           From perusal of the impugned order it appears<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>       that permanent Lok Adalat has observed that the<\/p>\n<p>       permanent Lok Adalat has got no jurisdiction either to<\/p>\n<p>       review or recall the order and award passed by the said<\/p>\n<p>       Court. The learned counsel for the petitioner is unable<\/p>\n<p>       to show any provision in the Legal Service Authority Act<\/p>\n<p>       which empowers the Lok Adalat to exercise either<\/p>\n<p>       review power or inherent power. In such view of the<\/p>\n<p>       matter, in exercise of power under Article 227 of the<\/p>\n<p>       Constitution of India no direction can be given to the<\/p>\n<p>       permanent Lok Adalat for an inquiry in the matter.<\/p>\n<p>                 However since the petitioner herself has stated<\/p>\n<p>       that she is not a party to the award passed by the Lok<\/p>\n<p>       Adalat,   she    may   if   so   advised   approach      before<\/p>\n<p>       appropriate forum by filing appropriate proceedings and<\/p>\n<p>       get her title declared as the award will not be binding<\/p>\n<p>       on her.\n<\/p>\n<p>                 With   the   above      observations,   this     writ<\/p>\n<p>       application is dismissed.\n<\/p>\n<\/p>\n<pre>S.S.
