SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/05\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent Civil Application under Section 5 of the Limitation Act has<br \/>\nbeen preferred by the applicants   original defendants to condone<br \/>\nthe delay of 98 days in preferring the Second Appeal challenging the<br \/>\nimpugned judgement and order dated 31\/07\/2008 passed by learned<br \/>\nAdditional District Judge, Bhavnagar in Regular Civil Appeal No.57 of<br \/>\n2008.\n<\/p>\n<p>\t\tThere<br \/>\nis no counter reply filed by any of the respondents. Mr.Lalakiya,<br \/>\nlearned advocate for Mr.R.M.Chhaya, learned advocate appearing on<br \/>\nbehalf of respondent Nos.3 and 4 has stated at the bar that he has no<br \/>\nobjection, if the delay is condoned.\n<\/p>\n<p>2.\t\tWith<br \/>\na view to give an additional opportunity to the applicants to submit<br \/>\ntheir case on merits rather than dismissing the same on technical<br \/>\nground of delay of 96 days in preferring the Second Appeal, delay in<br \/>\npreferring the Second Appeal is hereby condoned.
