HEMA, JJ.\n           -----------------------------------------------------\n                     W.P.(C)No. 14453 of 2008\n           -----------------------------------------------------\n\n            Dated this the       22nd day of May, 2008.\n\n                              JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J:\n<\/p>\n<p>          The petitioner seeks police protection for transporting<\/p>\n<p>clay mined from the property belonging to him in Vayakkara<\/p>\n<p>Village to his Tiles factory.     Respondents 5 and 6 have already<\/p>\n<p>moved the civil court by filing Ext.P5 suit seeking prohibitory<\/p>\n<p>injunction restraining the petitioner from mining               clay using<\/p>\n<p>mechanical devices and causing nuisance to them. It is common<\/p>\n<p>case that    injunction application in the said suit is pending<\/p>\n<p>consideration of the concerned court.<\/p>\n<p>           In view of decision of this Court in <a href=\"\/doc\/1000673\/\">Thilakan v. Circle<\/p>\n<p>Inspector<\/a> or Police (2008 (1) KLT 141), we think the proper forum<\/p>\n<p>to redress the grievance of the petitioner is the civil court<\/p>\n<p>concerned.     Accordingly, this Writ Petition is closed without<\/p>\n<p>prejudice to the contentions of the petitioner and his right to<\/p>\n<p>move other forums for appropriate reliefs.<\/p>\n<p>                                                    Sd\/-\n<\/p>\n<p>                                        K.
