No. 1500 of 2009-F\n                ==================\n          Dated this the 29th day of May, 2009.\n\n                         O R D E R\n<\/pre>\n<p>     Petitioners are accused in Crime No.640\/2005 of<\/p>\n<p>Kasaragod Police Station, now pending as S.C.No.401\/2006<\/p>\n<p>before Sessions Court, Kasaragod. Prosecution case is that<\/p>\n<p>all the accused committed offences under Sections 341, 324<\/p>\n<p>and 308 read with Section 34 of Indian Penal Code.<\/p>\n<p>Allegation is that on 3-9-2005 at about 8.30 PM while 2nd<\/p>\n<p>respondent\/defacto complainant was walking along the<\/p>\n<p>footpath in front of Roshi Jewellery, in furtherance of their<\/p>\n<p>common intention, 2nd petitioner attempted to beat him with<\/p>\n<p>an iron rode and when 2nd respondent evaded it, 3rd<\/p>\n<p>petitioner hit him with an iron rode, which was also evaded<\/p>\n<p>and the accused thereby committed the offence.          This<\/p>\n<p>petition is filed under Section 482 of Code of Criminal<\/p>\n<p>Procedure to quash the final report submitted in Crime<\/p>\n<p>No.640\/2005 taken cognizance by the Magistrate and now<\/p>\n<p>pending as S.C.No.401\/2006 contending that subsequently<\/p>\n<p>Crl.M.C.No.1500\/2009<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>the dispute between petitioners and 2nd respondent were<\/p>\n<p>settled amicably and now he has no grievance against<\/p>\n<p>petitioners and therefore he has no objection for quashing<\/p>\n<p>the proceedings.     Relaying on the decision of the Apex<\/p>\n<p>Court in Madan Mohan Aboot v. State of Punjab (2008 (3)<\/p>\n<p>KLT 19) it is contended that the case is to be quashed. 2nd<\/p>\n<p>respondent appeared through Counsel and also filed<\/p>\n<p>Crl.M.A.No.2449\/2009 along with an affidavit stating that<\/p>\n<p>they have settled the dispute and he has no intention to<\/p>\n<p>proceed with the case.\n<\/p>\n<p>      2.    Learned Counsel appearing for petitioners and 2nd<\/p>\n<p>respondent and learned Public Prosecutor were heard.<\/p>\n<p>      3.    Learned   Public  Prosecutor   on    instructions<\/p>\n<p>submitted that the dispute has been settled between the<\/p>\n<p>injured defacto complainant and accused and therefore no<\/p>\n<p>purpose would be served by proceeding with the trial.<\/p>\n<p>      4.    Allegation against  petitioners  is   that  they<\/p>\n<p>committed offences under Sections 341, 324 and 308 read<\/p>\n<p>Crl.M.C.No.1500\/2009<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>with Section 34 of Indian Penal Code. The case is purely<\/p>\n<p>personal      between    the  2nd  respondent, the  defacto<\/p>\n<p>complainant, who is the injured.         Annexure I Wound<\/p>\n<p>Certificate shows that only minor injuries were inflicted.<\/p>\n<p>Subsequent settlement of the dispute with 2nd respondent,<\/p>\n<p>the   injured      defacto  complainant, would  makes    the<\/p>\n<p>possibility     of  conviction very   bleak.
