SAHAI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 20\/01\/2011 \n\n \n\n \n \n\t\t\t\t\tORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>\t\tLearned<br \/>\nadvocate Mr.Paresh Darji states that he has instructions to appear<br \/>\nfor respondent nos. 1\/1 and 1\/2. He shall file his appearance for<br \/>\nrespondent no. 1\/2.\n<\/p>\n<p>2.\t\tHeard.\n<\/p>\n<p>Ad-interim relief granted earlier by order dated 29th November,2010<br \/>\nis made interim relief subject to following directions:\n<\/p>\n<p>(1)\tThe<br \/>\nTribunal has awarded Rs.29,76,680\/- by way of compensation. The<br \/>\nappellant challenged the award to the extent of Rs. 15 lacs. A total<br \/>\namount of Rs. 49,23,345\/- has been deposited by the appellant<br \/>\npursuant to the award which is in addition to Rs. 50,000\/- paid<br \/>\nearlier by way of no fault liability.\n<\/p>\n<p>(2)\tOut<br \/>\nof the amount deposited, an amount of Rs. 25 lacs shall be placed in<br \/>\ncumulative fixed term deposit  in any nationalised bank in the name<br \/>\nof the Nazir of the District Court initially for a period of five<br \/>\nyears to be renewed thereafter for a period of one year from time to<br \/>\ntime till final disposal of the Appeal or till further order that may<br \/>\nbe passed by this Court.\n<\/p>\n<p>\t\tOut<br \/>\nof the remaining amount, an amount of Rs. 21 lacs shall be placed in<br \/>\nfixed deposit in equal amount between the two  claimants with any<br \/>\nnationalised bank by way of term deposit for a period of five years<br \/>\nto be renewed thereafter for a period of one year from time to time<br \/>\ntill final disposal of the Appeal or till further order that may be<br \/>\npassed by this Court. The fixed term deposit receipt shall be kept in<br \/>\nthe custody of the Nazir of the Court and shall not be pledged or<br \/>\nused for raising any fund. The periodical interest that may accrue<br \/>\nthereon shall be paid to the claimants.\n<\/p>\n<p>\t\tThe<br \/>\nremaining amount shall be paid to the claimants in equal amount<br \/>\nbetween the two claimants by cross account payee cheques.
