First<\/p>\n<p>Year on the ground that he was not having requisite<\/p>\n<p>percentage of 45% in the qualifying examination.<\/p>\n<p>2-    It is averred in the petition that the petitioner<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>possessed 41.89% marks in graduation. He appeared in<\/p>\n<p>the entrance test for admission in 3 years LL.B. course in<\/p>\n<p>which 40% marks in graduation were required. As he<\/p>\n<p>fulfilled the criteria he was permitted to participate in<\/p>\n<p>the entrance examination and admission was given to<\/p>\n<p>him, but, suddenly his admission was cancelled on the<\/p>\n<p>ground that he was having 41.89% marks in graduation,<\/p>\n<p>not 45% as required. Petitioner filed a representation<\/p>\n<p>which was not considered. Hence, petition has been<\/p>\n<p>preferred.\n<\/p>\n<p>3-    In the return filed by the respondents No.2 and 3 it<\/p>\n<p>is contended that Bar Council of India has framed the<\/p>\n<p>Rules of Legal Education and as per Part-IV Chapter II<\/p>\n<p>Rule 7 minimum marks to be obtained in the qualifying<\/p>\n<p>examination is 45% in the case of general        category<\/p>\n<p>candidates for admission in 3 years LL.B. course. The<\/p>\n<p>guidelines dated 22.5.2009 framed by the College were<\/p>\n<p>not in tune with the rules of legal education framed by<\/p>\n<p>the Bar Council of India having statutory force. When<\/p>\n<p>said fact came to the notice, error was rectified vide<\/p>\n<p>letter dt.25.7.2009, it was clarified that for 5 years<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>course and also for 3 years LL.B. course, the minimum<\/p>\n<p>qualifying marks are fixed as 45% for general category<\/p>\n<p>candidates as prescribed by the Bar Council of India.<\/p>\n<p>Petitioner was admitted on 23.7.2009 and order of<\/p>\n<p>cancellation was passed on 7.8.2009 within two weeks of<\/p>\n<p>admission. No case is made out so as to interfere in the<\/p>\n<p>writ petition.\n<\/p>\n<p>4-    Shri V.K. Shukla, learned counsel appearing on<\/p>\n<p>behalf of the petitioner has submitted that admission was<\/p>\n<p>rightly given in view of admission bulletin for LL.B. First<\/p>\n<p>Semester published by the Rani Durgawati Vishwa<\/p>\n<p>Vidyalaya, Jabalpur in which it was mentioned in para 4<\/p>\n<p>and 12 that admission in the First Year has to be on the<\/p>\n<p>basis of entrance examination in qualifying examination<\/p>\n<p>and graduation or post-graduation incumbent must<\/p>\n<p>possess 40% marks. Guidelines (P\/3) issued by Higher<\/p>\n<p>Education Department in para 5.3 has also been relied<\/p>\n<p>upon by the petitioner which provides that for admission<\/p>\n<p>in the First Year Course of LL.B. in case entrance test is<\/p>\n<p>conducted        40%   marks   are     required   and    in<\/p>\n<p>graduation\/post-graduation and       45% in case entrance<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>examination is not conducted.\n<\/p>\n<p>5-    Counsel appearing on behalf of the respondents<\/p>\n<p>have relied upon the Bar Council of India Rules framed<\/p>\n<p>under the Advocates Act contained in Part-IV. Chapter II<\/p>\n<p>Rule 7    of BCI Rules. The BCI has prescribed the<\/p>\n<p>standard vide Resolution No.110\/2008 which came in<\/p>\n<p>force w.e.f. 14.9.2008. The resolution provides that<\/p>\n<p>minimum percentage         in the qualifying examination<\/p>\n<p>should not be below 45% of the total marks in case of<\/p>\n<p>general category candidate and 40% of total marks in<\/p>\n<p>case of SC\/ST candidates. It is contended that it was not<\/p>\n<p>open to the State Govt. or to University to violate the<\/p>\n<p>binding directive of BCI, thus, the guidelines which were<\/p>\n<p>framed by University and State Govt. were corrected to<\/p>\n<p>bring them in tune with the rule 7 contained in Part IV<\/p>\n<p>Chapter II of BCI Rules.\n<\/p>\n<p>6-    No doubt about it that in the admission guidelines<\/p>\n<p>issued by the University and the State Govt. it was<\/p>\n<p>provided that minimum percentage for general category<\/p>\n<p>candidate is 40% in case admission is by holding<\/p>\n<p>entrance examination and in case it is not conducted<br \/>\n<span class=\"hidden_text\">                              5<\/span><\/p>\n<p>qualifying percentage in the graduation\/post graduation<\/p>\n<p>had been fixed at 45%. However, said guidelines are in<\/p>\n<p>contravention of BCI Rules Rule 7 contained in Chapter<\/p>\n<p>II Part IV of the BCI Rules framed under the Advocates<\/p>\n<p>Act which have the statutory force. BCI has power to<\/p>\n<p>prescribe the standard for the purpose of standards of<\/p>\n<p>legal education and recognition of degrees in law for the<\/p>\n<p>purpose of enrolment as advocate and inspection of<\/p>\n<p>Universities for recognizing its degree in law under<\/p>\n<p>sections 7(1)(h) and (I), 24(1)(c)(iii) and (iiia), 49(1)(af),<\/p>\n<p>(ag), and (d) of the Advocates Act, 1961. the rules have<\/p>\n<p>statutory force Rule 7 contained in Chapter II of Part IV<\/p>\n<p>of Bar Council of India Rules is as follows :<\/p>\n<p>                &#8220;7.     Minimum          marks     in<br \/>\n          qualifying examination for admission.<\/p>\n<p>                Bar council of India may from time<br \/>\n          to   time,    stipulates    the   minimum<br \/>\n          percentage of marks not below 45% of<br \/>\n          the total marks in case of general<br \/>\n          category applicants and 40% of the total<br \/>\n          marks in case of SC and ST applicants, to<br \/>\n          be    obtained     for     the   qualifying<br \/>\n          examination, such as +2 Examination in<br \/>\n          case of Integrated Five Years&#8217; course or<br \/>\n          Degree course in any discipline for Three<br \/>\n          years&#8217; LL.B. course, for the purpose of<br \/>\n          applying for and getting admitted into a<br \/>\n          Law Degree Program of any recognized<br \/>\n          University in either of the streams.\n<\/p>\n<p><span class=\"hidden_text\">                            6<\/span><\/p>\n<p>         Provided that such a minimum qualifying<br \/>\n         marks shall not automatically entitle a<br \/>\n         person to get admission into an<br \/>\n         institution but only shall entitle the<br \/>\n         person     concerned    to  fulfill  other<br \/>\n         institutional criteria notified by the<br \/>\n         institution   concerned    or     by   the<br \/>\n         government concerned from time to time<br \/>\n         to apply for admission.&#8221;\n<\/p>\n<p>\n      It is apparent from Rule 7 of the aforesaid rules<\/p>\n<p>that Bar Council of India has prescribed minimum<\/p>\n<p>percentage of marks not below 45% in case of general<\/p>\n<p>category and 40% in case of SC\/ST candidates to be<\/p>\n<p>obtained in the qualifying examination, such as +2<\/p>\n<p>examination in case of integrated five years course or in<\/p>\n<p>Degree course in any discipline for admission in three<\/p>\n<p>years&#8217; LL.B. course. It is pre-requisite for admission into<\/p>\n<p>the law degree programme of any recognized University<\/p>\n<p>in either scheme.   Proviso also makes it clear that the<\/p>\n<p>person who possess minimum qualifying marks has also<\/p>\n<p>to fulfill other institutional criteria notified by the<\/p>\n<p>institution concerned or by the government concerned<\/p>\n<p>from time to time to apply for admission. By making<\/p>\n<p>provision of entrance test institutional criteria has been<\/p>\n<p>prescribed, but, in no case it was open to the University<br \/>\n<span class=\"hidden_text\">                            7<\/span><\/p>\n<p>to violate the directive of the BCI contained in Rule 7<\/p>\n<p>Chapter II Part IV of the Bar Council of India Rules. Rule<\/p>\n<p>is mandatory and it could not have been by-passed by<\/p>\n<p>making the provision of entrance test. The prescribing of<\/p>\n<p>40% marks in the qualifying examination for 3 years<\/p>\n<p>course amounted to dilution of the mandatory direction<\/p>\n<p>of the BCI. Bar Council of India has prescribed aforesaid<\/p>\n<p>standard in exercise of various provisions of Advocate<\/p>\n<p>Act referred to above.         Realizing the mistake the<\/p>\n<p>respondents have rightly cancelled the admission and it<\/p>\n<p>was rightly realized by the State Government and the<\/p>\n<p>College that such a dilution of the standard prescribed<\/p>\n<p>by the BCI is not permissible. Admission was cancelled<\/p>\n<p>within 15 days. It cannot be said that the action taken<\/p>\n<p>was illegal in any manner. It was in accordance with<\/p>\n<p>mandatory directive    of BCI. The guidelines (P\/2, P\/3)<\/p>\n<p>which were framed were not in tune of mandatory<\/p>\n<p>directive of the BCI. The State and University had<\/p>\n<p>realized their mistake and rightly taken the curative<\/p>\n<p>steps.\n<\/p>\n<p>7-       We do not find any merit in the submission of<br \/>\n<span class=\"hidden_text\">                                       8<\/span><\/p>\n<p>        counsel that the petitioner be awarded compensation as<\/p>\n<p>        he was wrongly admitted in the course. His admission<\/p>\n<p>        was cancelled within 15 days. However, as conceded by<\/p>\n<p>        counsel appearing for respondent the admission fee and<\/p>\n<p>        tuition fee which may have been deposited shall be<\/p>\n<p>        refunded to the petitioner.\n<\/p>\n<p>        8-    Resultantly, we find no merit in this petition, same<\/p>\n<p>        is dismissed.
