NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     The petitioner  was promoted  as Inspector of Police on<br \/>\nJuly  10,   1973  and\twas  further   promoted\t as   Deputy<br \/>\nSuperintendent of  Police on  April 8,\t1982. The contesting<br \/>\nrespondents    were    directly\t   recruited\tas    Deputy<br \/>\nSuperintendents on March 25, 1982. Their inter- se seniority<br \/>\nis regulated by Rule 25 of the Mizoram Police Service Rules,<br \/>\n1986. Rules, 1986. Rules 25 reads as under:\n<\/p>\n<blockquote><p>     &#8220;25. Seniority  &#8211; The Administrator<br \/>\n     shall prepare  a list of members of<br \/>\n     the Service  arranged in  order  of<br \/>\n     seniority as    determined\t in  the<br \/>\n     manner specified below :-\n<\/p><\/blockquote>\n<blockquote><p>     (i) (a)  Persons recruited\t on  the<br \/>\n     results\tof    the    competitive<br \/>\n     examination in  any year  shall  be<br \/>\n     ranked INTER  SE in  the  order  of<br \/>\n     merit in  which they  are placed at<br \/>\n     the competitive  examination on the<br \/>\n     results   of    which   they    are<br \/>\n     recruited, those  recruited on  the<br \/>\n     basis  of\tan  earlier  examination<br \/>\n     being  ranked   senior   to   those<br \/>\n     recruited on  the basis  of a later<br \/>\n     examination.\n<\/p><\/blockquote>\n<blockquote><p>     (b) The relative seniority INTER SE<br \/>\n     of persons\t recruited by  selection<br \/>\n     shall be determined on the basis of<br \/>\n     the order\tin which their names are<br \/>\n     arranged in the list prepared under<br \/>\n     rule 13,  those  recruited\t on  the<br \/>\n     basis of an earlier selection being<br \/>\n     ranked senior to those recruited on<br \/>\n     the basis of a later selection.\n<\/p><\/blockquote>\n<blockquote><p>     (ii) The  seniority of  members  of<br \/>\n     the  Service   appointed\tat   the<br \/>\n     initial constitution of the Service<br \/>\n     in accordance  with the  provisions<br \/>\n     of part  VI of these rules shall be<br \/>\n     determined by  the Administrator in<br \/>\n     consultation with the Board.<br \/>\n\t  Provided that\t in the\t case of<br \/>\n     persons appointed\tunder  sub  rule\n<\/p><\/blockquote>\n<blockquote><p>     (i) of  the rule 15, if two or more<br \/>\n     persons  belonging\t  to  the   same<br \/>\n     parent service  or\t Department  are<br \/>\n     thus  appointed,\tthey  shall   be<br \/>\n     ranked  INTER   SE\t in  the  parent<br \/>\n     Service or\t Department as\tthe case<br \/>\n     may be.\n<\/p><\/blockquote>\n<blockquote><p>     (iii)  The\t relative  seniority  of<br \/>\n     direct recruits  and  of  promotees<br \/>\n     shall be  determined  according  to<br \/>\n     the rotation  of vacancies\t between<br \/>\n     direct recruits and promotees which<br \/>\n     shall be  based on\t the  quotas  of<br \/>\n     vacancies\t reserved   for\t  direct<br \/>\n     recruitment  and\tpromotion  under<br \/>\n     rule 5.&#8221;<\/p><\/blockquote>\n<p>     In the  matter of\tfixation of  the inter\tse seniority<br \/>\nunder  Rule   25(iii),\tthe  relative  seniority  of  direct<br \/>\nrecruits and  of promotees has to be determined according to<br \/>\nthe  rotation  of  vacancies  between  direct  recruits\t and<br \/>\npromotees which\t shall be  based on  the quotas of vacancies<br \/>\nreserved for  direct recruitment and promotion under Rule 5.<br \/>\nThe Division Bench has pointed out in the impugned order the<br \/>\nposition as under:\n<\/p>\n<blockquote><p>     &#8220;Clause  (ii)  of\trule  25  quoted<br \/>\n     above clearly  stipulated that  the<br \/>\n     seniority of  the service appointed<br \/>\n     at the  initial constitution of the<br \/>\n     service shall  be determined by the<br \/>\n     administrator in  constitution with<br \/>\n     the   Board.    Since    all    the<br \/>\n     Respondents have  been appointed as<br \/>\n     members of\t service at  the initial<br \/>\n     constitution   of\t service   their<br \/>\n     seniority has  to be  determined by<br \/>\n     the  Administrator\t  in  accordance<br \/>\n     with the said rules.&#8221;<\/p><\/blockquote>\n<p>     Shri P.K.\tGoswami,  learned  senior  counsel  for\t the<br \/>\npetitioner, contends  that in  view of\tthe definition under<br \/>\nRule 2(g)  of `service&#8217;\t read  with  Rule  5,  the  inter-se<br \/>\nseniority  falls  to  be  due.\tWe  find  no  force  in\t the<br \/>\ncontention. The\t statutory rule 25(iii), as indicated above,<br \/>\nclearly postulates that the inter se seniority of the direct<br \/>\nrecruits  and\tthe  promotees\t has  to  be  determined  in<br \/>\naccordance with\t quota and  rotation. Accordingly  seniority<br \/>\nwas rightly  determined\t as  per  the  respective  dates  of<br \/>\nappointment. Therefore, the rotation has to be considered as<br \/>\nper the\t date of  appointment and  in  accordance  with\t the<br \/>\nvacancy under  the rules.  Otherwise, the rule of rota-quota<br \/>\nunduly gets disturbed.\n<\/p>\n<p>     When the  claims for  promotion to\t the post  of  Addl.<br \/>\nSuperintendent of  Police had  come up for consideration, in<br \/>\nthe meeting  held  by  the  DPC\t on  October  6,  1988,\t the<br \/>\npetitioner was\tfound to be unfit and contesting respondents<br \/>\nwere found to be fit as per the proceedings indicated in the<br \/>\njudgment of the High Court. As a consequence, the petitioner<br \/>\ncould not claim right to promotion at that time on the basis<br \/>\nof the assessment made by the DPC or to seniority over those<br \/>\npromoted  as   per  the\t  recommendation  of  the  DPC.\t The<br \/>\npetitioner may\tbe found  fit at  a later stage of selection<br \/>\nbut he\tcannot get seniority over the persons who were found<br \/>\nfit in\tthe meeting  held on October 6, 1988 and promoted on<br \/>\nOctober 20,  1988 and  have already  got promoted  to higher<br \/>\npost i.e.  Addl. Superintendent\t of Police.
