DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/07\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1\tThis<br \/>\nappeal from order arises out of the order dated 13th May<br \/>\n2010 passed by City Civil Court below applications Exh.6 and 7 in<br \/>\nCivil Suit No.994 of 2009.\n<\/p>\n<p>2\tThe<br \/>\nsuit was filed by the plaintiff for a permanent injunction against<br \/>\nthe defendants on the grounds mentioned in the plaint and also<br \/>\npleaded for interim relief against the defendants.\n<\/p>\n<p>3\tThe<br \/>\ndispute of the land in the suit is pertaining to width of the private<br \/>\nroad mentioned in the plaint. According to the plaintiff, the width<br \/>\nof the private road is 4.80 meters whereas the defendants contended<br \/>\nthat the width of the road was reduced to 2.17 meters.\n<\/p>\n<p>4\tThe<br \/>\nAhmedabad Municipal Corporation, who has granted B.U. permission to<br \/>\nthe defendants to construct on the land in question, has verified<br \/>\nfrom its records and reported that the width of the private road is<br \/>\n2.17 meters and even the site was also supervised by an officer of<br \/>\nthe Corporation and no illegality was found by the officer about<br \/>\nconstruction carried out by the defendants.\n<\/p>\n<p>5\tIn<br \/>\nthe above circumstances, when the defendants have agreed to keep open<br \/>\nthe space of 7 feet of the private road, they cannot be restrained<br \/>\nfrom carrying out the construction on the land in question for which<br \/>\nthe plan is sanctioned and permission is granted by the  Ahmedabad<br \/>\nMunicipal Corporation, subject to the outcome of the suit.\n<\/p>\n<p>6\tWith<br \/>\nthe aforesaid direction,  this appeal from order and the civil<br \/>\napplication are disposed of with no order as to costs.\n<\/p>\n<p>(ANANT<br \/>\nS.
