Justice KURIAN JOSEPH\n\n Dated :04\/08\/2009\n\n O R D E R\n                 S.R.BANNURMATH, C.J. &amp;\n                   KURIAN JOSEPH,J.\n        -------------------------------------------------\n               W.P(C)No.16719 of 2009\n       --------------------------------------------------\n          Dated this the 4th day of August, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>Kurian Joseph,J.\n<\/p>\n<p>     Petitioner approached this court in public interest praying<\/p>\n<p>for a direction to the second and third respondents to take<\/p>\n<p>appropriate action on their representations. The following are<\/p>\n<p>the main prayers:-\n<\/p>\n<blockquote><p>            (a)   issue a writ of mandamus or any other<\/p>\n<p>                  appropriate     writ,  order   or   direction,<\/p>\n<p>                  directing the second and third respondents<\/p>\n<p>                  not to take the stage carriages in custody<\/p>\n<p>                  during its trip without breaking the service;<\/p>\n<\/blockquote>\n<blockquote><p>            (b)   issue a writ of mandamus or any other<\/p>\n<p>                  appropriate     writ,  order   or   direction,<\/p>\n<p>                  directing respondents 2 and 3 to issue<\/p>\n<p>                  atleast 48 hours sufficient notice mentioning<\/p>\n<p>                  the offence, in case the custody of the<\/p>\n<p>                  vehicle is necessary;\n<\/p><\/blockquote>\n<p>W.P(C).No.16719 of 2009<\/p>\n<p><span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>            (c)    issue a writ of mandamus or any other<\/p>\n<p>                   appropriate writ, or order, directing the second<\/p>\n<p>                   and third respondents to release the vehicle<\/p>\n<p>                   when the vehicle is taken in custody after<\/p>\n<p>                   giving notice immediately or within a time limit<\/p>\n<p>                   as prescribed by this Honourable Court.<\/p>\n<p>            (d)    issue a writ of mandamus or any other<\/p>\n<p>                   appropriate writ, order or direction, directing<\/p>\n<p>                   respondents 2 and 3 to issue receipt for the<\/p>\n<p>                   documents collected if any by the Police<\/p>\n<p>                   Officers from the crew or owner of the stage<\/p>\n<p>                   carriage.\n<\/p>\n<p>We are afraid, there cannot be any direction by this court as far<\/p>\n<p>as prayers, especially, (a) to (c) are concerned. We find that the<\/p>\n<p>petitioner has filed a detailed representation before the 3rd<\/p>\n<p>respondent. The learned Government Pleader submits that the<\/p>\n<p>3rd respondent will look into the same with notice to the petitioner<\/p>\n<p>and take appropriate action in accordance with law in the matter<\/p>\n<p>W.P(C).No.16719 of 2009<\/p>\n<p><span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>expeditiously.   The submission is recorded.
