While<br \/>\n\tadmitting the petitioner in the school, the petitioner&#8217;s date of<br \/>\n\tbirth was mentioned as 12.05.1971 instead of 11.05.1971.<br \/>\n\tAccordingly, School Leaving Certificate mentions the petitioner&#8217;s<br \/>\n\tdate of birth as 12.05.1971 instead of 11.05.1971.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>\tM.N. Devnani, learned advocate appearing for the petitioner has<br \/>\n\tsubmitted that the mistake of one day might have occurred either by<br \/>\n\tthe mistake of the relative of the petitioner or school authority<br \/>\n\tonly because of the fact that the petitioner was born at midnight at<br \/>\n\tabout 02.00 O&#8217;clock.  The petitioner applied for passport and while<br \/>\n\tmaking application, all the relevant documents including the school<br \/>\n\tleaving certificate were produced and the passport was issued to the<br \/>\n\tpetitioner showing the petitioner&#8217;s date of birth as 12.05.1971<br \/>\n\tinstead of 11.05.1971.  He has, however, submitted that the<br \/>\n\tpetitioner has not produced the birth certificate given to the<br \/>\n\tpetitioner by the Registrar of Birth and Death.  It is only because<br \/>\n\tof this, the discrepancy arose.  When the petitioner has applied for<br \/>\n\trenewal of the passport pointing out that the date of birth should<br \/>\n\tbe mentioned as 12.05.1971, the authorities have not acceded to this<br \/>\n\trequest and hence, the petitioner has to file the present petition<br \/>\n\tbefore this Court.\n<\/p>\n<p>\tThis<br \/>\n\tCourt has issued notice for final disposal on 22.04.2009.  Notice<br \/>\n\twas duly served on the respondent authority and Mr. V.D. Pargi,<br \/>\n\tlearned Central Government Counsel has filed his appearance.   He<br \/>\n\thas submitted that once the date of birth is entered into in the<br \/>\n\tpassport, it is not open for the authority to get it changed, unless<br \/>\n\tand until some directions are issued by the Court to that effect.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned advocates appearing for the parties and having gone<br \/>\n\tthrough the documents attached along with the petition, the Court is<br \/>\n\tof the view that the correct date of birth of the petitioner is<br \/>\n\t11.05.1971 which is duly recorded in the birth certificate issued by<br \/>\n\tthe Sub-Registrar, Death and Birth, Vyara Nagarpalika under the<br \/>\n\tprovisions of the Birth and Death Registration Act, 1971.  It is<br \/>\n\ttrue that initially, some mistake was committed at the time of his<br \/>\n\tseeking admission in the school and school leaving certificate<br \/>\n\trecords the date of birth as 12.05.1971. However, it seems that<br \/>\n\tthere is a genuine and bonafide mistake which can certainly be<br \/>\n\trectified on the basis of the birth certificate.  There is a settled<br \/>\n\tlegal position that if there is some discrepancy in the date of<br \/>\n\tbirth in two different documents, namely, school leaving certificate<br \/>\n\tand birth certificate, the date of birth as mentioned in the birth<br \/>\n\tcertificate should be accepted as the correct one.\n<\/p>\n<p>\tIn<br \/>\n\tthe above view of the matter, the respondent   passport authority<br \/>\n\tis hereby directed to renew the passport of the petitioner<br \/>\n\tmentioning the date of birth as 11.05.1971 instead of 12.05.1971 as<br \/>\n\tit is the correct date of birth of the petitioner as per the birth<br \/>\n\tcertificate issued by the Sub-Registrar, Birth and Death, Vyara<br \/>\n\tNagarpalika.\n<\/p>\n<p>\tSince<br \/>\n\tthe petitioner has approached this Court for giving certain<br \/>\n\tdirections to the passport authorities and for that purpose, the<br \/>\n\tpassport authorities are required to engage counsel, cost of<br \/>\n\tRs.3,000\/- is awarded and the same should be deposited by the<br \/>\n\tpetitioner with the passport authorities.\n<\/p>\n<p>\tSubject<br \/>\n\tto the aforesaid direction and observation, this petition is<br \/>\n\taccordingly disposed of.
