SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 7676 of 2009\n                ------------------------------------\n            Dated this the 15th day of January, 2010\n\n\n                           O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioner is accused<\/p>\n<p>No.1 in Crime No.179\/2009 of Thottilpalam Police Station,<\/p>\n<p>Kozhikode District.\n<\/p>\n<p>     2.   The offences alleged against the petitioner are under<\/p>\n<p>Section 304 of the Indian Penal Code and Sections 3 and 6 of the<\/p>\n<p>Explosive Substances Act.\n<\/p>\n<p>     3.   When the Bail Application came up for hearing on<\/p>\n<p>07.01.2010, the following order was passed:<\/p>\n<blockquote><p>                 &#8220;After having heard the learned counsel<\/p>\n<p>           for the petitioner and the learned Public<\/p>\n<p>           Prosecutor, I am of the view that before<\/p>\n<p>           disposing    of   the    Bail   Application, an<\/p>\n<p>           opportunity should be given to the petitioner<\/p>\n<p>           to appear before the investigating officer.<\/p>\n<p>           Accordingly, there will be a direction to the<\/p>\n<p>           petitioner to appear before the investigating<\/p>\n<p>           officer at 9 A.M. on     10th and 11th January,<\/p>\n<p>           2010.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 7676 of 2009             2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                     Post on 15.01.2010.\n<\/p><\/blockquote>\n<blockquote><p>                     It is submitted by the learned Public<\/p>\n<p>              Prosecutor that the petitioner will not be<\/p>\n<p>              arrested until further orders in connection with<\/p>\n<p>              Crime No.179\/2009 of Thottilpalam Police<\/p>\n<p>              Station, Kozhikode.\n<\/p><\/blockquote>\n<blockquote><p>                     The petitioner shall produce copy of this<\/p>\n<p>              order before the investigating officer.<\/p>\n<\/blockquote>\n<blockquote><p>                     Hand over copy to both sides.&#8221;<\/p><\/blockquote>\n<p>      4. It is submitted by the learned counsel for the petitioner<\/p>\n<p>and the learned Public Prosecutor that the petitioner has<\/p>\n<p>complied with the direction contained in the order dated<\/p>\n<p>07.01.2010.\n<\/p>\n<p>      5.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs.15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p><span class=\"hidden_text\">B.A. No. 7676 of 2009            3<\/span><\/p>\n<blockquote><p>         A) The petitioner shall        report    before      the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Mondays, till the final report is filed<br \/>\n             or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The      petitioner  shall   appear    before     the<br \/>\n             investigating officer for interrogation as and<br \/>\n             when required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution witnesses or tamper with the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>        The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                    K.T.
