Lodha, J.<\/p>\n<p> 1. Heard Mr.    Nusrat Shah, learned counsel<br \/>\nfor petitioner and  Mr.    K.P.    Ravi,  learned<br \/>\ncounsel for respondent Nos.1 and 2.\n<\/p>\n<p> 2. The petitioner Ms.  Fathema Hussain Sayed<br \/>\n(minor) is a student of standard VI  in  Karthika<br \/>\nEnglish School (respondent No.2).  It is her case<br \/>\nthat she was asked by the Principal of the School<br \/>\nto  not  to  attend  class from 28.11.2001 if she<br \/>\nwore the head scarf.  This direction given by the<br \/>\nPrincipal to  the  petitioner  on  28.11.2001  is<br \/>\nunder challenge  in  this  writ  petition.    The<br \/>\npetitioner says that she hails from Muslim family<br \/>\nand follows the Islam religion and since the Holy<br \/>\nQuran provides that a female child after 9  years<br \/>\nof  age  should  cover  her  head  by  scarf, she<br \/>\nstarted  wearing  head-scarf  from  June,   2001.<br \/>\nAccording to her, head-scarf does not violate the<br \/>\ndress  code  or the discipline of respondent No.2<br \/>\nschool and therefore, the direction given by  the<br \/>\nPrincipal   on   28.11.2001   is   violative   of<br \/>\npetitioners  fundamental  right  of  freedom  of<br \/>\nconscience   and   professing,   propagating  and<br \/>\npracticing Islam religion.\n<\/p>\n<p> 3. Before we advert to  the  merits  of  the<br \/>\nmatter,  we  observe  that the petitioner for the<br \/>\nself-same relief filed earlier writ petition  No.<br \/>\n357 of   2002.     The  said  writ  petition  was<br \/>\nwithdrawn  by  the   petitioner   and   dismissed<br \/>\naccordingly vide order dated 11th February, 2002.<br \/>\nThe order reads thus-\n<\/p>\n<p>  &#8220;The  learned  counsel  appearing<br \/>\nfor  the  petitioner   seeks   leave   to<br \/>\nwithdraw the  petition.    Leave granted.<br \/>\nPetition is dismissed as withdrawn.&#8221;\n<\/p>\n<p> 4. It is clear from the aforesaid order that<br \/>\nneither  liberty  to approach the court again was<br \/>\nsought nor granted.  It is against public  policy<br \/>\nto  permit a litigant to approach the court again<br \/>\nand again once the matter has been  withdrawn  by<br \/>\nhim unconditionally.   Mr.   Nusrat Shah, learned<br \/>\ncounsel for the petitioner submitted  that  there<br \/>\nis  no  estoppel  against statute and if there is<br \/>\nviolation of fundamental  right,  the  petitioner<br \/>\ncan  file  100 writ petitions again and again and<br \/>\nagain so long as infraction of fundamental  right<br \/>\ncontinues.  We are afraid, the sweeping statement<br \/>\nof the  learned counsel cannot be accepted.  If a<br \/>\nlitigant exercises his right in  approaching  the<br \/>\ncourt  and  complains  infraction  of fundamental<br \/>\nright, the  process  must  be  taken  to  logical<br \/>\nconclusion.   Such  litigant,  if  withdraws  the<br \/>\nproceeding unconditionally and without liberty to<br \/>\nfile fresh proceeding, he may not be permitted to<br \/>\napproach the court again and again because it  is<br \/>\nagainst the public policy even though there is no<br \/>\nquestion of res-judicata or estoppel.\n<\/p>\n<p> 5. Even if we assume that petitioner may  be<br \/>\npermitted  to  file  second  writ petition though<br \/>\nfirst  writ  petition   was   withdrawn   without<br \/>\nliberty,  we  find  it  difficult  to  accept the<br \/>\nsubmission of the learned  counsel  that  by  not<br \/>\npermitting the petitioner to wear head-scarf, the<br \/>\nfundamental right of the petitioner under Article<br \/>\n25 is  violated.    Article 25 of Constitution of<br \/>\nIndia reads thus-\n<\/p>\n<p> &#8220;25.Freedom  of  conscience  and free<br \/>\nprofession, practice and  propagation  of<br \/>\nreligion.-  (1)  Subject to public order,<br \/>\nmorality and  health  and  to  the  other<br \/>\nprovisions  of this Part, all persons are<br \/>\nequally entitled to freedom of conscience<br \/>\nand the right freely to profess, practise<br \/>\nand propagate religion.\n<\/p>\n<p> (2) Nothing in this article shall<br \/>\naffect the operation of any existing  law<br \/>\nor prevent the State from making any law-\n<\/p>\n<p> (a) regulating or restricting any<br \/>\neconomic, financial, political or<br \/>\nother  secular activity which may<br \/>\nbe  associated   with   religious<br \/>\npractice;\n<\/p>\n<p> (b)  providing for social welfare<br \/>\nand reform or the  throwing  open<br \/>\nof  Hindu  religious institutions<br \/>\nof  a  public  character  to  all<br \/>\nclasses and sections of Hindus.\n<\/p>\n<p> Explanation  I.-  The wearing and<br \/>\ncarrying of kirpans shall be deemed to be<br \/>\nincluded in the profession  of  the  Sikh<br \/>\nreligion.\n<\/p>\n<p> Explanation  II.-  In  sub-clause\n<\/p>\n<p>(b)  of  clause  (2),  the  reference  to<br \/>\nHindus  shall be construed as including a<br \/>\nreference to persons professing the Sikh,<br \/>\nJaina  or  Buddhist  religion,  and   the<br \/>\nreference to Hindu religious institutions<br \/>\nshall be construed accordingly.\n<\/p>\n<p> 6. By  asking  petitioner  who is student in<br \/>\nclass VIth standard of respondent No.2 school  to<br \/>\nmaintain the dress code prescribed by the school,<br \/>\nhow   can   it  be  said  that  the  petitioners<br \/>\nfundamental right of freedom  of  conscience  and<br \/>\nfree  profession,  practice  and  propagation  of<br \/>\nreligion is violated.  Article 25 guarantees that<br \/>\nevery person  in  India  shall  have  freedom  of<br \/>\nconscience  and  shall have the right to profess,<br \/>\npractice  and  propagate  religion,  subject   to<br \/>\nrestrictions  imposed by the state on the grounds<br \/>\nof (i) public order, morality  and  health;  (ii)<br \/>\nother   provisions  of  the  Constitution;  (iii)<br \/>\nregulation of non-religious  activity  associated<br \/>\nwith  religious practice; (iv) social welfare and<br \/>\nreform etc.  There  does  not  seem  to  be  such<br \/>\nestablished  practice and profession of the Islam<br \/>\nreligion from  covering their heads by the  girls<br \/>\nstudying in  all  girls  school.    The   learned<br \/>\ncounsel  for  the  petitioner  however, sought to<br \/>\nplace reliance upon verse 31 of chapter 24-64  of<br \/>\nHoly Quran (Quran-E-Majid).  Verse 31 reads thus-<br \/>\n  &#8220;31. And  say  to  the believing women<br \/>\nthat they cast down their looks and guard<br \/>\ntheir private parts and not display their<br \/>\nornaments except  what  appears  thereof,<br \/>\nand  let  them  wear their head-coverings<br \/>\nover their bosoms, and not display  their<br \/>\nornaments  except  to  their  husbands or<br \/>\ntheir fathers, or the  fathers  of  their<br \/>\nhusbands,  or  their sons, or the sons of<br \/>\ntheir husbands,  or  their  brothers,  or<br \/>\ntheir  brothers  sons, or their sisters<br \/>\nsons, or their women, or those whom their<br \/>\nright hands possess, or the male servants<br \/>\nnot  having  need  (of  women),  or   the<br \/>\nchildren  who have not attained knowledge<br \/>\nof what is hidden of women; and let  them<br \/>\nnot  strike  their feet so that what they<br \/>\nhide of their ornaments may be known; and<br \/>\nturn to Allah all of  you,  O  believers!<br \/>\nso that you may be successful.\n<\/p>\n<p> 7. A girl student not wearing the head-scarf<br \/>\nor  head  covering  studying  in  exclusive girls<br \/>\nsection cannot be said to in  any  manner  acting<br \/>\ninconsistent  with  the  aforesaid  verse  31  or<br \/>\nviolating any injunction provided in Holy  Quran.<br \/>\nIt  is  not  an  obligatory overt act enjoined by<br \/>\nMuslim religion that a girl studying in all  girl<br \/>\nsection must  wear head-covering.  The essence of<br \/>\nMuslim religion or Islam cannot be said  to  have<br \/>\nbeen  interfered with by directing petitioner not<br \/>\nto wear head-scarf in the school.\n<\/p>\n<p> 8. We, therefore, do not find any  merit  in<br \/>\nthe  contention  of  the  learned counsel for the<br \/>\npetitioner that direction given by the  Principal<br \/>\nto  the  petitioner  on 28.11.2001 to not to wear<br \/>\nhead-scarf or  cover  her  head  while  attending<br \/>\nschool is violative of Article 25 of Constitution<br \/>\nof India.\n<\/p>\n<p> 9. It would not be out of place  to  mention<br \/>\nhere  that  after  28.11.2001  the petitioner has<br \/>\nbeen attending school regularly  without  wearing<br \/>\nthe head-scarf or head-covering.\n<\/p>\n<p> 10.
