Agnihotri, J\n\n Dated:28\/02\/2008 \n\n: Judgment \n\n                          O R D E R\n<\/pre>\n<p>         (Passed on this 28th day of February, 2008)<\/p>\n<p>  1.   The present petition filed under Article 226\/227 of the<\/p>\n<p>       Constitution of India impugns the order dated 2.9.2006<\/p>\n<p>       (Annexure P\/6) passed by the respondent No.4 &#8211; Sarpanch,<\/p>\n<p>       Gram Panchayat, Jamri, whereby the petitioner has been<\/p>\n<p>       terminated from the post of (Secretary) Panchayat Karmi of<\/p>\n<p>       the Gram Panchayat Jamri, Block &#8211; Dongargarh, District &#8211;\n<\/p>\n<p>       Rajnandgaona.\n<\/p>\n<p>2.   The indisputable facts are that the petitioner was<br \/>\nappointed as Panchayat Karmi (Secretary) by order dated<br \/>\n16.1.1999 (Annexure P\/1).  The Collector, Rajnandgaon sent a<br \/>\ncommunication dated 28.10.2005 (Annexure P\/4) to the Chief<br \/>\nExecutive Officer, Janpad Panchayat, Dongargarh, stating<br \/>\nthat in the light of the report dated 13.10.2005 it is<br \/>\nestablished that the petitioner had collected money for<br \/>\nconstruction of dry-latrine from 21 families living below<br \/>\nthe poverty line and misappropriated the same. It was<br \/>\ndirected to lodge F.I.R. against the petitioner and take<br \/>\nnecessary action for his removal from the post of Secretary.\n<\/p>\n<p>3.   Thereafter, the petitioner received a show cause notice<br \/>\ndated 24.2.2006 (Annexure P\/2), issued by the respondent<br \/>\nNo.2, stating therein that in a preliminary enquiry the<br \/>\nallegations of financial irregularities and misbehaviour<br \/>\nwith the panchayat office bearers and villagers have been<br \/>\nfound proved. The petitioner was called upon to submit his<br \/>\nreply within a period of three days asto why the appointment<br \/>\nof the petitioner under Section 69(1) of the Chhattisgarh<br \/>\nPanchayat Raj Adhiniyam, 1993, on the post of Secretary be<br \/>\nnot cancelled.\n<\/p>\n<p>4.   In compliance of the above show cause notice dated<br \/>\n24.2.2006 the petitioner submitted his reply dated 7.3.2006<br \/>\n(Annexure P\/3), denying the allegations levelled against<br \/>\nhim.\n<\/p>\n<p>5.   In response to the memo dated 14.5.2006 issued by the<br \/>\nJanpad Panchayat, Dongargarh and memo dated 29.4.2006 issued<br \/>\nby the Social Welfare Department, Rajnandgaon, a meeting of<br \/>\nthe village Panchayat as well as Gram Sabha was convened on<br \/>\n1.6.2006 and the resolution (Annexure P\/5) was passed to<br \/>\nremove the petitioner from the post of Panchayat Karmi and<br \/>\nPanchayat Secretary. Consequent thereupon, the impugned<br \/>\norder dated 2.9.2006 (Annexure P\/6) was passed by the<br \/>\nrespondent No.4 &#8211; Sarpanch, Gram Panchayat, Jamri, removing<br \/>\nthe petitioner from the post of (Secretary) Panchayat Karmi.\n<\/p>\n<p>6.   Learned counsel appearing for the petitioner would<br \/>\nsubmit that the petitioner was not informed about any kind<br \/>\nof complaints received against him, before issuing the show<br \/>\ncause notice dated 24.2.2006 (Annexure P\/2) and the alleged<br \/>\nenquiry conducted by the Chief Executive Officer. Likewise,<br \/>\nthe petitioner was not aware about the allegation of<br \/>\ncollection and misappropriation of money from 21 families<br \/>\nand the alleged enquiry report dated 13.10.2005, as is<br \/>\nmentioned in the communication dated 28.10.2005 (Annexure<br \/>\nP\/4). The serious allegations were found proved in an<br \/>\nenquiry, in absence of the petitioner. The petitioner was<br \/>\nnot afforded any opportunity of hearing to put forward his<br \/>\ncase before report was submitted and thereafter before<br \/>\naction was taken on the report. Granting three days time,<br \/>\nwhen it was decided to remove the petitioner from the post<br \/>\nof Secretary, was not sufficient and reasonable to put<br \/>\nforward his case on each and every allegation, which had<br \/>\nalready been fond proved before notice dated 24.2.2006<br \/>\n(Annexure P\/2) was issued by the respondent No.2.\n<\/p>\n<p>7.   Learned counsel appearing for the petitioner would<br \/>\nfurther submit that Rule 7 of the Chhattisgarh Panchayat<br \/>\nService (Discipline and Appeal) Rules, 1999   (for short<br \/>\n`the Rules, 1999&#8242;) provides for procedure before terminating<br \/>\nservice of a member of the Panchayat. In the instant case,<br \/>\nthe said provisions were not followed, no definite charges<br \/>\nwere framed and the petitioner was not served with the<br \/>\narticles of charges before holding an enquiry leading to<br \/>\ntermination of the petitioner from his services.\n<\/p>\n<p>8.   Learned counsel would further submit that the<br \/>\ntermination order was passed on the basis of the allegation<br \/>\nthat the petitioner had committed irregularities and<br \/>\nmisbehaviour in performance of his duties. The order is<br \/>\nstigmatic and removal from service comes within the purview<br \/>\nof major penalty, the same could not have been passed<br \/>\nwithout following the procedure as laid down in  the<br \/>\nprovisions of law, as prescribed in Rule 7 of the Rules<br \/>\n1999.\n<\/p>\n<p>9.   Despite service of notice, the respondent No. 3 Chief<br \/>\nExecutive Officer, Janpad Panchayat, Dongargarh and the<br \/>\nrespondent No.4 Sarpanch, Gram Panchayat Jamri, Block<br \/>\nDongargarh, have chosen not to appear in the proceeding.\n<\/p>\n<p>10.  Shri U. N. S. Deo, learned counsel appearing for the<br \/>\nrespondents No. 1, 2 and 5 would categorically submit that<br \/>\non perusal of the papers it is evident that the procedure<br \/>\nprescribed in Rule 7 of the Rules, 1999 have not been<br \/>\nfollowed. The petitioner was appointed on 16.1.1999 and<br \/>\nwithout following the due process of law, the petitioner has<br \/>\nbeen removed on 2.9.2006 on the basis of the resolution<br \/>\npassed by the concerned Gram Panchayat and Gram Sabha, which<br \/>\nis not sustainable in law.\n<\/p>\n<p>11.  Admittedly, the Gram Panchayat, before passing the<br \/>\nimpugned termination order has not complied with the<br \/>\nprovisions of Rule 7 of the Rules, 1999. This Court in<br \/>\nDhaluram Kosaria Vs. State of C.G. &amp; others1, Beegan Ram Vs.<br \/>\nState of C.G. &amp; others2 and Prakash Chand Soni Vs. State of<br \/>\nC.G. &amp; othrs3 has held that the non compliance of the<br \/>\nstatutory provisions and denial of principles of natural<br \/>\njustice tantamounts to infraction of not only the provisions<br \/>\nof Rule 7 of the Rules, 1999 but the provisions of Article<br \/>\n311 (2) of the Constitution of India also. The order of<br \/>\nremoval being penal in nature, visiting with civil (evil)<br \/>\nconsequences, cannot be passed without holding the enquiry<br \/>\nin accordance with the elaborate provisions, as prescribed<br \/>\nin Rule 7 of the Rules,1999.\n<\/p>\n<p>12.  It is thus clear that the respondents have not followed<br \/>\nthe statutory provisions of law before passing the impugned<br \/>\norder.\n<\/p>\n<p>13.  On the question of back wages, no foundation has been<br \/>\nlaid to establish the fact that whether the petitioner was<br \/>\ngainfully employed elsewhere or not during this period. Even<br \/>\notherwise, keeping in view that the termination order has<br \/>\nbeen vitiated not on merit but on account of non-compliance<br \/>\nof the statutory provisions before terminating the services<br \/>\nof the petitioner, 30% back wages would be sufficient in the<br \/>\ninterest of justice.\n<\/p>\n<p>14.  In view of the foregoing, the petition is allowed. The<br \/>\nimpugned order dated 2.9.2006 (Annexure P\/6) is quashed.
