The learned<br \/>\nadvocate further states, on instructions from his clients, that there<br \/>\nwas no &#8216;pucca&#8217; construction, it was only &#8216;kutcha  wada&#8217;<br \/>\nand that has been vacated by the petitioners.\n<\/p>\n<p>2.\tIn<br \/>\nlight of that statement the Court does not pass any further order of<br \/>\nrecovery of rent from the petitioners from the date they claimed<br \/>\npossession of the land in question, viz. 1988.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr.Niraj J. Sharma for the petitioners.  Mr.Sharma<br \/>\nvehemently submitted that the auction which took place on 21st<br \/>\nJanuary 1988 was not legal and there were various flaws in the<br \/>\nauction as the authorities did not comply with necessary provisions<br \/>\nfor the same.  Besides that the case of the petitioners is that as<br \/>\nthe land is adjoining to the residential premises of the petitioners<br \/>\nand the petitioners are in possession of the land and they are using<br \/>\nthat land for keeping their cattle; the authorities ought to have<br \/>\nconsidered the application filed by the petitioners as early as on<br \/>\n27th August 1985, a copy of which is produced at page 16<br \/>\nand thereafter another application dated 10th February<br \/>\n1987, a copy of which is produced at page 15.  It is contended by the<br \/>\nlearned advocate that the authorities ought to have considered the<br \/>\nrequest of the petitioners and ought to have granted the land to the<br \/>\npetitioners.\n<\/p>\n<p>4.\tIn<br \/>\nthe present case, the auction was held on 21st January<br \/>\n1988 by the Sarpanch-respondent no.4 herein. It is the case of the<br \/>\nauthorities that it was after necessary permission was granted by the<br \/>\nTaluka Development Officer the auction was held. Subsequently, the<br \/>\nTaluka Development Officer sanctioned  sanction the auction dated<br \/>\n21st January 1988 on 29th April 1988. The<br \/>\npetitioners being aggrieved by the outcome of the auction, challenged<br \/>\nthat auction before the Deputy Collector by filing Appeal No.42 of<br \/>\n1988, which came to be allowed by the Deputy Collector  by order<br \/>\ndated 30th December 1988 whereby the Deputy Collector was<br \/>\npleased to quash the order of auction and remitted the matter to  the<br \/>\nTaluka Development Officer, Palanpur for ascertaining as to whether<br \/>\nthe land in question is a &#8216;Gamtal,&#8217; a &#8216;Gauchar&#8217; or a<br \/>\nGovernment land and if there is unauthorized possession of the<br \/>\npetitioners, the same should be removed and thereafter, fresh<br \/>\ndecision be taken.\n<\/p>\n<p>Against<br \/>\nthis order of the Deputy Collector, the affected parties, viz.<br \/>\nrespondents no.5 to 9 filed an appeal which came to be decided by the<br \/>\nCollector by judgment and order dated 29th January 1991,<br \/>\nwho allowed the appeal and quashed and set aside the order passed by<br \/>\nthe Deputy Collector dated 30th December 1988 and<br \/>\nconfirmed the order sanctioning the auction sale by the Taluka<br \/>\nDevelopment Officer dated 29th April 1988.  Against this<br \/>\norder of the Collector, the present petitioners preferred the appeal<br \/>\nbefore the SSRD, who decided the same by judgement and order dated<br \/>\n7th October 1992, who confirmed the order of the Collector<br \/>\ndated 29th January 1991.  In the result the order of  the<br \/>\nTaluka Development Officer dated 29th April 1988<br \/>\nsanctioning the auction stood confirmed.\n<\/p>\n<p>5.\tThus,<br \/>\nthere are sane findings recorded by three authorities, firstly by<br \/>\nthe Taluka Development Officer, secondly by the Collector and thirdly<br \/>\nby the SSRD.\n<\/p>\n<p>6.\tThe<br \/>\nlearned advocate for the petitioner has vehemently submitted that the<br \/>\nauthorities below have committed error in not considering the<br \/>\nimportant aspect of the matter, namely, the land is situated adjacent<br \/>\nto the residential premises of the petitioner, that the petitioners<br \/>\nare in possession of the premises and that the requisite procedure<br \/>\nwas not followed by the authorities-Sarpanch in holding the auction.\n<\/p>\n<p>None<br \/>\nof these contentions found favour with the authorities.  Besides, all<br \/>\nthese questions are the questions of disputed facts and therefore,<br \/>\nthis Court refused to go into any of these questions.  Even<br \/>\notherwise, it appears from the record that the petitioners encroached<br \/>\nupon the land and then claimed the land by way of indulgence from the<br \/>\nauthorities by saying that the land be given to them by a deeming<br \/>\nauction or by fixing a price for the same taking into consideration<br \/>\nthe fact that the land is adjacent to their residential premises and<br \/>\nthat they are in possession thereof.  The learned advocate could not<br \/>\nsatisfactorily convince this Court that any gross illegality or<br \/>\nirregularity is committed in holding the auction and therefore, this<br \/>\npetition  fails and the same is dismissed.  Rule is discharged. No<br \/>\norder as to costs.\n<\/p>\n<p>(RAVI<br \/>\nR.
