SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner-Palitana Nagarpalika has prayed for an appropriate<br \/>\nwrit, order or direction quashing and setting aside the impugned<br \/>\njudgement and award dated 23\/01\/2009 passed by the Industrial<br \/>\nTribunal, Bhavnagar in Reference (I.T.) No. 36\/2001 by which the<br \/>\nIndustrial Tribunal has directed the petitioner to grant all the<br \/>\nbenefits to the respondents, which are available to permanent<br \/>\nemployees\/safai kamdar and has granted permanency benefits to the<br \/>\nrespondents with effect from 2005.\n<\/p>\n<p>2.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties, it is not in dispute that both the respondents are working<br \/>\nas daily wagers\/safai kamdars and there is no sanction set up<br \/>\nsanctioned by the appropriate authority.  It appears that the<br \/>\nIndustrial Tribunal has granted  permanency benefits to the<br \/>\nrespondents on the ground that they are working as daily wagers since<br \/>\nmany years.  Considering the decision of Hon&#8217;ble Supreme Court in the<br \/>\ncase of  SECRETARY, STATE OF KARNATAKA AND ORS Vs. UMADEVI AND<br \/>\nORS.  reported in (2006)<br \/>\n4 SCC 1 the impugned judgement<br \/>\nand award passed by the Industrial Tribunal to grant permanency<br \/>\nbenefits to the respondents  cannot be sustained.\n<\/p>\n<p>3.\tAt<br \/>\nthis stage, Shri Prajapati, learned advocate appearing on behalf of<br \/>\nthe respondents has stated that the petitioner has already approached<br \/>\nthe appropriate authority for increasing the strength of the safai<br \/>\nkamdar and to sanction the set up and, therefore,  it is requested to<br \/>\nmake suitable observation that as and when the set up is increased,<br \/>\nin that case, the case of the respondents be considered for permanent<br \/>\nappointment alongwith other similarly situated safai kamdar.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated hereinabove, the<br \/>\nimpugned judgement and award  passed by the Industrial Tribunal dated<br \/>\n23\/01\/2009 in Reference (I.T.) No. 36\/2001 is hereby quashed and set<br \/>\naside.  However, it is observed that as and when there is sanction<br \/>\nset up by the appropriate authority, the case of the respondents<br \/>\nalongwith other similarly situated safai kamdar be considered in<br \/>\naccordance with law.\n<\/p>\n<p>5.\tWith<br \/>\nthis, the present petition is allowed.  Rule is made absolute to the<br \/>\naforesaid extent.
